Supreme Court Rules New York’s Concealed Carry Restrictions Unconstitutional

Fox News: The Supreme Court Thursday ruled 6-3 that New York’s regulations that made it difficult to obtain a license to carry a concealed handgun were unconstitutionally restrictive, and that it should be easier to obtain such a license. The existing standard required an applicant to show “proper cause” for seeking a license, and allowed New York officials to exercise discretion in determining whether a person has shown a good enough reason for needing to carry a firearm. Stating that one wished to protect themselves or their property was not enough (Fox News). Daily Wire: The case centered on a 1911 New York state law that conditioned the right to a concealed carry permit on “good moral character” and “proper cause.” The Supreme Court majority opinion, written by Justice Clarence Thomas, took issue with the latter condition, which unlawfully forced New Yorkers to demonstrate “a special need for self-defense” (Daily Wire). Mike Gallagher: The judiciary matters. It’s where we as a people have to live or die by the law of the land. And the Supreme Court just upheld the right to get a concealed weapon, a concealed carry permit in the state of New York, where the bar is set ridiculously high (Daybreak Daily).

FDA Orders Juul E-Cigarettes Be Removed From Circulation

Associated Press: Federal health officials on Thursday ordered Juul to pull its electronic cigarettes from the U.S. market, the latest blow to the embattled company widely blamed for sparking a national surge in teen vaping. The action is part of a sweeping effort by the Food and Drug Administration to bring scientific scrutiny to the multibillion-dollar vaping industry after years of regulatory delays. The FDA said Juul must stop selling its vaping device and its tobacco and menthol flavored cartridges. Those already on the market must be removed. Consumers aren’t restricted from having or using Juul’s products, the agency said. To stay on the market, companies must show that their e-cigarettes benefit public health. In practice, that means proving that adult smokers who use them are likely to quit or reduce their smoking, while teens are unlikely to get hooked on them (Associated Press). Virginia Kruta: “They ban it, I’ll do it live on TV. They can come and arrest me. How’s that?” @seanhannity promises to throw down over proposed Juul ban (Twitter).

Senators Ted Cruz and John Barrasso Introduce Legislation Hardening Schools

Daily Wire: Senators Ted Cruz (R-TX) and John Barrasso (R-WY) introduced a bill on Wednesday that would dedicate more than $38 billion to increase school and community safety, including doubling the number of school resource officers nationwide. “The Safe Kids, Safe Schools, Safe Communities Act of 2022″ would be funded with unspent American Rescue Plan funds, according to the proposed legislation (Daily Wire). Breitbart: The legislation also focuses on making sure that the National Instant Criminal Background Check System (NICS) has all the information necessary in its system to perform a thorough background check. This means all records that could disqualify someone from a purchase would be included. And the Act heightens punishment for gun crimes, including gun theft. Additionally, the legislation authorizes “$150 million to hire additional federal prosecutors to prosecute firearm violations…[and] $29 million for safe school task forces and combatting juvenile firearm violations” (Breitbart). Ted Cruz: Our Safe Kids, Safe Schools, Safe Communities Act would focus on making schools safer by increasing the number of properly trained school resource officers on campus who can deter and, if necessary, stop school shooters before our kids are harmed, increasing the number of school mental health professionals who can identify at-risk children and ensure those kids get the help they need before they become violent, and providing funding to improve the physical security measures for schools (Ted Cruz).

Department of Education Agrees to Forgive 200,000 Student Loans to the Tune of $6 Billion

CNBC: The U.S. Department of Education has agreed to cancel the student loans of around 200,000 people who brought a class-action lawsuit against the government, claiming they were stuck with federal debts from schools that were found to have misled them. Under the terms of the Sweet v. Cardona settlement, the Education Department will immediately approve around $6 billion in debt forgiveness. The 200,000 borrowers eligible for the relief will get full cancellation of their debt, refunds of amounts paid and repair to their credit… The project compiled a list of the dozens of schools that are involved in the settlement and that the Education Department has determined engaged in misconduct (CNBC). Daily Wire: Education Secretary Miguel Cardona lauded the settlement, which the U.S. District Court for the Northern District of California will independently review before approval… Earlier this month, the Department of Education canceled debt from former attendees of Corinthian Colleges, which filed for bankruptcy in 2015. The move forgave $5.8 billion in debt among 560,000 borrowers (Daily Wire).

Biden Administration Proposes Extending Title IX to Include Trans Protections

Washington Post: On the 50th anniversary of Title IX, the Biden administration proposed sweeping changes to the landmark law that would bar schools, colleges and universities from discriminating against transgender students, a move that comes as the battle over transgender rights moves to the front lines of the culture war. The proposal would extend the protections of Title IX, which prohibits schools that get federal funds from discriminating on the basis of sex, to transgender students, compelling schools to accommodate and protect them. This includes permitting them to use bathrooms that align with their gender identity, using their correct pronouns and addressing bullying based on their gender identity. It would also amend the rules that govern how schools, colleges and universities investigate and resolve claims of sexual assault and sexual harassment (Washington Post). Josh Hawley: Amazing. The Biden Administration’s new rule today on Title IX denies there are such things as women and men. The Admin is erasing gender & women from a statute designed to protect them (Twitter).

Biden Administration: Dismantling US Energy Is to “Accelerate the Transition”

Wall Street Journal: On his first day in office, Mr. Biden canceled the Keystone XL pipeline and halted new leases in Alaska’s Arctic National Wildlife Refuge. A week later, he banned new oil and gas leases on federal lands and waters, and in June he shut down exploration on existing leases in ANWR. In October, he increased the regulatory burdens on building pipelines and other infrastructure. This February he limited leasing in Alaska’s National Petroleum Reserve. At every turn Team Biden has worked to restrict and reduce domestic oil and gas production. Team Biden got what it wanted: Daily U.S. oil production dropped from 12.29 million barrels in 2019 to an estimated 11.85 million in 2022, well after demand had rebounded from the pandemic. Mr. Biden blames Vladimir Putin, but prices rose quite a bit before Russia invaded Ukraine. In January 2021, the average price of regular gasoline was $2.33 a gallon. By February 2022, it was up to $3.52. As of May, the average price was $4.44; so 56% of that price rise predated the invasion (Wall Street Journal). RNC Research: “Since day one, President Biden has tried to limit fossil fuels supplies — and we’re all paying for it. Do you dispute?” Top Biden energy advisor Amos Hochstein laughs, then admits they’re working to “accelerate the transition” (RNC Research). Townhall: GRANHOLM: “As long as our nation remains overly reliant on oil and fossil fuels, we’ll feel these price shocks again…the only way out…is diversifying our fuel sources by deploying clean energy” (Twitter).

After Parental Outrage, San Francisco School Returns to Merit-Based Admission

San Francisco Chronicle: After nearly two years of intense and bitter debate, test scores and grades will once again determine which San Francisco students are admitted to Lowell High School after the city’s school board decided to return to the merit-based admission system Wednesday. In a 4-3 vote, the school board decided to restore the previous merit process after two years of using a lottery-based system. The vote will now apply to freshman entering in the fall of 2023 as well as future classes, unless the board takes further action in the future to change the admission process (San Francisco Chronicle). National Review: The board first voted in favor of a switch to the lottery system in October 2020 because they said remote learning created a lack of academic data on which to base admissions decisions. Four months later, the board made the decision to permanently switch to a lottery system in an effort to address alleged racism and a lack of diversity at the elite academic school. That vote faced a legal challenge, which ended in a judge ruling that the district had violated laws related to the Brown Act that regulate public meetings. The board reversed the decision to permanently instate lottery-based admissions and then extended the lottery process for another year. The latest vote comes months after San Francisco voters recalled three progressive school board members in a February election. The recall movement was driven by parent concern that the board was more concerned with social justice than reopening schools during the pandemic, recall organizers said at the time (National Review).

Henrietta, NY Denied Planned Parenthood Building Permit in 3-2 Vote

WHEC: The Henrietta Town Board voted to deny an application for a permit to establish a new Planned Parenthood clinic within the town on Wednesday night. The 3-2 vote to deny comes after Henrietta residents from both sides expressed strong opinions at a Wednesday board meeting. Planned Parenthood is the largest abortion provider in the US (WHEC). Fox News: Abortion – always a contentious issue in national and state politics – has rapidly become the most prominent topic in U.S. politics as a Supreme Court decision threatens to overturn Roe v. Wade. The anticipation for a ruling in this case has already led to protests outside the Supreme Court and the homes of several justices, as well as an attempted murder charge against a man who allegedly plotted to kill Justice Brett Kavanaugh (Fox News).

Europe Enters Energy Crisis Amid Russia Turning Off Supply

CNN: Europe’s biggest economy is now officially running short of natural gas and is escalating a crisis plan to preserve supplies as Russia turns off the taps. Germany on Thursday activated the second phase of its three-stage gas emergency program, taking it one step closer to rationing supplies to industry — a step that would deliver a huge blow to the manufacturing heart of its economy. German economy minister Robert Habeck said he hoped rationing wouldn’t be necessary to get through the coming winter, but couldn’t rule it out. ”Gas is from now on in short supply in Germany,” he told reporters at a press conference in Berlin. “Even if you don’t feel it yet: We are in a gas crisis” (CNN). Insider: Last week, Gazprom cut gas flows through the Nord Stream 1 pipeline to Germany by 60%. Russia’s state gas company said the move stemmed from the West’s withholding key turbines because of sanctions. But while Europe braces for a difficult winter with measures to reduce energy demand, RBC commodities chief Helima Croft said the US hasn’t taken similar steps when it comes to gasoline and efforts to lower those prices (Insider).

Amazon Creating Alexa Capable of Replicating Real Voices of People Alive or Dead

Wall Street Journal: Amazon.com Inc. is developing a voice-mimicking feature for its virtual assistant Alexa that replicates the speech of people alive and dead, joining other companies that are experimenting with creating digital memories of people after death. Rohit Prasad, head scientist of Alexa, showed a video clip of the new feature in action at Amazon’s re:MARS 2022 conference on artificial intelligence on Wednesday. The clip showed a boy asking Alexa to read him “The Wizard of Oz” in the voice of his grandmother. Alexa then switched from its default voice to a softer voice. Mr. Prasad said Alexa is able to mimic voices after accessing less than a minute of recorded audio of a voice. “While AI can’t eliminate that pain of loss, it can definitely make the memories last,” Mr. Prasad. An Amazon spokesman declined to say when the new feature will be rolled out to consumers (Wall Street Journal). Just because something could happen doesn’t mean it should happen. Think of the implications past recalling memories from a loved one such as creating false recording or using the voice recognition software to access someone’s personal data.
