Fossil fuel companies are petitioning the Supreme Court to overturn a lower court decision that could allow local and state governments to sue them for damages they cause to the climate.
Big Oil thinks it can weasel its way out of paying for the havoc it is wreaking on the environment by running to the conservative majority on SCOTUS. If they succeed, then the only avenue left to hold them accountable will be through Congress. And knowing this Supreme Court and how it’s likely to rule, we’re going to need all the help in Congress that we can get.

Companies like Exxon and Suncor Energy are placing their faith in the pro-fossil fuel conservative Justices on the Supreme Court to reverse a ruling by the 10th U.S. Circuit Court of Appeals that delivered a procedural victory to Colorado governments suing fossil fuel companies for climate damages.
Big Oil wants cases like this to be heard by federal courts because they believe that a federal judge could find that the Clean Air Act preempts the municipalities’ claims.
In light of Republican obstruction on climate at the federal level, local and state governments have been taking charge to protect our environment and hold fossil fuel companies accountable. But, John, we need action in Congress to ensure Big Oil doesn’t find a way to dodge its responsibility to protect our climate.
