John -- I’ve stayed in close contact with Team Cisneros this week, and I can tell you, Jessica is determined to see this through until every vote is counted.
Here’s what’s happening:
Some people’s ballots were disqualified on Election Day for various reasons (signature not matching, etc.). Anyone who cast a vote that was disqualified now has a window of opportunity to “cure” their ballot, meaning, to correct whatever the deficiency is so their vote will be counted.
That’s a complicated process, and Texas election law deliberately makes it hard for people to know what their rights are. So Jessica’s team is reaching out to voters who’ve been disenfranchised and making sure they have the information they need.
There are also still mail-in ballots to process, more than enough to swing the outcome of the election. And until every single one is counted, we won’t know the real vote margin.
Lastly, the margin as it stands (which we expect to narrow) is well within the bounds of a recount under Texas election law.
A recount would cost a considerable amount of money and additional time – resources that could be better spent on defeating the Republican candidate in the general election. So, we’re hoping for a clear resolution when every vote is counted.
What’s important to know is that Jessica is not giving up – and neither are we.

Henry Cuellar may have smugly declared victory on election night, but he stands completely alone on that claim. Not a single media outlet has called the race in his favor – in fact, all of them report it as too close to call.
The stakes in this election are high and we are staying the course. No matter the outcome in TX-28 or any other race, BNC will continue to fight for justice and equal representation for all.
