FDA’s Refusal to Finalize PMTA Process Until July 2023 Allows Teen Vaping Crisis to Continue 

With a court filing stating that FDA will continue to delay completion of its PMTA process through June 30, 2023--two years past a federal court-ordered deadline--the agency is allowing the youth vaping crisis to continue unabated.


As parents, we are outraged that FDA is willing to keep flavored e-cigarettes on the market for another year—especially menthol products, among the most popular with millions of teens who currently vape. Based on FDA’s own science about menthol’s harm to youth--laid out in its recent historic regulations ending sales of menthol cigarettes—the agency should remove menthol e-cigarettes immediately.

Every day that goes by without FDA’s full regulation of these products means the tobacco industry will continue profiting from its predatory behavior towards kids, securing Big Tobacco a new generation of life-long customers.
