The Roe v. Wade decision came in 1973. In the decades since, the Supreme Court has taken on a Catholic majority – seven Catholics counting Justice Gorsuch, six appointed by Republican presidents. It is naive to think that their views on abortion are not shaped by their religious beliefs. (Justice Sotomayor did not add her name to the majority draft opinion.) Justice Alito’s draft begins and ends with the subject of morality, but where else does his morality, and that of the concurring justices, come from but their religion? Religion and government are not separated in the judicial process on this issue, or on several others currently being considered by the Supreme Court – including school prayer and government funding of religious schools.
