Sen. Ed Markey ([link removed]) (D-MA) called for Congress to “expand” the Supreme Court on Monday ([link removed]) , as activists chanted “pack the Court!” outside the building after the leak of a draft SCOTUS decision that would overturn the Roe v. Wade (1973) decision on abortion.
Court-packing refers to the idea of adding seats to the Supreme Court and immediately filling the vacancies with reliably loyal justices. Democrats pushed the idea after the confirmation of Justice Brett Kavanaugh in 2018, which gave the Court a nominal 5-4 conservative majority that has since expanded to 6-3 since Justice Amy Coney Barrett replaced the late Justice Ruth Bader Ginsburg ([link removed]) .
“A stolen, illegitimate, and far-right Supreme Court majority appears set to destroy the right to abortion, an essential right which protects the health, safety, and freedom of millions of Americans. There is no other recourse. We must expand the court,” Markey ranted on Twitter.
Fact check: the Supreme Court is neither stolen nor illegitimate, nor does it have a far-right majority; indeed, there is no one on the bench who could be considered far-right. For that matter, most of the Supreme Court Justices deemed conservative are not even reliably conservative in their decisions. But Markey and the Left rage against any institution that does not guarantee them total power, all the time.

On April 15, 2021, Markey unveiled ([link removed]) the Judiciary Act Of 2021, which called for the expansion of the U.S. Supreme Court to 13 Justices instead of 9. Accusing Republicans of having broken the Court with the confirmation of Justice Amy Coney Barrett in 2020, Markey said: “As a result, we have a stilted, illegitimate 6-3 conservative majority on the court that has caused this crisis of confidence in our country.” “The Republicans stole two seats on the Supreme Court,” Markey added, “and now it is up to us to repair that damage. Our democracy is in jeopardy today because the Supreme Court’s standing is solely damaged. And the way we repair it is straightforward. These four new seats, to be filled by president Biden, will reconstitute the United States Supreme Court. The bench will then rightfully reflect the values of the majority of the American people
on whose behalf they serve…. Expanding the Supreme Court rights the wrongs the Republicans have done to this great Court. Expanding the Supreme Court is equal justice and will ensure equal justice is dispensed to all Americans.”
