Tim Alexander Statement on the Reported Supreme Court Draft Decision
John,
Our rights are under attack. A draft decision [[link removed]] by the SCOTUS has come out that would completely overturn Roe v. Wade.
This leaked draft decision is highly disturbing, disheartening, and shameful. The Supreme Court of the United States, acting in a nakedly partisan manner to overturn a long-standing precedent, is an open invitation to the Republican-controlled States to strip away a woman’s control over her own body. Simply reprehensible.
Furthermore, Americans should make no mistake that this decision will be the cornerstone for an assault on other unenumerated rights rooted in the same understanding of our right to privacy as Roe v. Wade . Any lawyer or jurist will recognize that the explicit mention of Lawrence v. Texas and Obergefell v. Hodges while tearing down the reasoning behind Roe is an invitation for states to attack those decisions in the courts, despite Justice Alito’s single line later that this decision should not be interpreted to overturn anything else.
Justice Alito failed to analyze Justice Goldberg’s consenting opinion in Griswold “the Ninth Amendment reveal[s] that the Framers of the Constitution believed that there are additional fundamental rights, protected from governmental infringement, which exist alongside those fundamental rights specifically mentioned in the first eight constitutional amendments.”
Decisions on reproductive health should be made privately between a woman and her doctor, without the government’s involvement. Taking that freedom away from half the population based on one’s body parts is plain and simple discrimination. If the Supreme Court does not uphold the right to choose, Congress and the Senate must act immediately to protect it and codify that right into law.
Jeff Van Drew has already demonstrated his lack of willingness to stand up and defend women when he voted against the Women’s Health Protection Act. When elected to Congress, I pledge that I will not stop fighting until a woman’s right to choose is enshrined into law. No government has the right to control a woman’s reproductive health, nor should lawmakers feel comfortable discussing imposing reproductive health restrictions.
