Friend, while conservative justices insist the Supreme Court has not been reduced to a partisan arm of the Republican Party, the American people increasingly see the true picture.
One recent example: The Court's conservative majority quietly reinstated a Trump-era rule limiting states' ability to protect their lakes and rivers from pollution – and they did it using the Court's “shadow docket,” which allows the majority to make a ruling without providing any rationale for their decision.
Perhaps they were too embarrassed by the giveaway to polluters to show their reasoning. It would be no surprise if big polluters were behind the millions of dollars in anonymous dark money spent to capture the Court – they certainly seem to be getting some major benefits out of the scheme.
Meanwhile, Justice Clarence Thomas has refused to recuse himself from cases related to the Jan. 6 insurrection, even though his wife has been implicated in the effort to overturn the election, texting directly with Trump’s Chief of Staff Mark Meadows.
The Supreme Court has the loosest ethical standards of any branch of the federal government and it’s increasingly problematic. I have been leading the effort to close the gap. It’s a fight that is more consequential than ever.
But this work depends on Democrats defending the Senate in November. If Senate control falls back into the hands of Mitch McConnell, he will protect the big donors who’ve captured the Court, at whatever cost to our democracy. We’ve all seen the lengths he’ll go to when it’s the Supreme Court.
