We are in a critical moment in the fight to restore our asylum system. Yesterday, a Trump-appointed federal judge temporarily paused the Biden administration from winding down the Title 42 policy before May 23rd. And now back from recess, a handful of Democratic and Republican lawmakers are working to pass anti-immigration legislation that would prevent the end of Title 42 expulsions and continue blocking asylum seekers from exercising their legal rights to seek protection. This is not just bad politics — Title 42 is a policy with a death toll. People’s lives are on the line.
Whether the challenge is coming from the courthouse or Congress, it is more important than ever that our elected officials do what’s morally, legally, and politically right and stand firm in their support of ending Title 42 expulsions for good. Thankfully senators like Senators Schumer (D-NY), Markey (D-MA), Menendez (D-NJ), Warren (D-MA), Padilla (D-CA), Hirono (D-HI), Merkley (D-OR), Wyden (D-OR), Feinstein (D-CA), Sanders (I-VT), Booker (D-NJ), Durbin (D-IL), Heinrich (D-NM), Lujan (D-NM), Cardin (D-MD), and Van Hollen (D-MD) are doing just that.

President Biden just released his comprehensive border plan that will be implemented to end Title 42 in May. It’s crucial that senators continue to stand with immigrant and border communities as this plan unfolds and oppose the “Public Health and Border Security Act” that would keep Trump and Stephen Miller’s plans in place, and any other legislative efforts to delay rescission or maintain the use of Title 42 expulsions.
