A Message from CHBA CEO, Neil Moody, Regarding UBCM Paper

I want to take this opportunity to address the Union of British Columbia Municipality (‘UBCM’) paper Building BC: Housing Completions & Population Growth 2016-2021, released on March 23, which erroneously disputes evidence of our province’s housing supply crisis. Instead, this paper claims that housing supply is meeting demands and that local governments are not primarily responsible for the supply gap, and, concerningly, wholesale change to the approval process isn’t necessary given record construction activity.
Unfortunately, UBCM deflects responsibility by pointing to other issues, using misleading data and quoting a past CHBA BC submission out of context to support their message.
Against undeniable, mounting evidence of housing supply shortages, opinions from industry experts, and concerted action from higher levels of government to build more supply - UBCM stands alone in their position.
For CHBA BC, the need is straightforward: by 2041, we will see B.C.’s population increase by 1.3 million people who will need a place to call home. Scotiabank established that Canada has a structural housing shortage. The number of dwellings per capita in the country is lower than any other G7 country and has failed in right-sizing the number of homes relative to the population. An additional 1.8 million dwellings is needed to catch up.
While B.C. has done well in recent years by meeting the challenge of increasing supply with higher numbers of registered homes and housing starts, there are decades of supply shortages to make up for as we face a peak immigration period. The province still falls well below the G7 dwellings per capita average. Addressing the supply side of the housing equation has been dismissed for far too long, and demand for housing is here to stay. Therefore, we need to remain steadfast in our challenge to government at all levels to make the approval process of building homes and creating communities more streamlined, predictable, collaborative and, importantly, accountable.
Many issues are contributing to the complex housing challenges. Although labour and supply chain shortages impact construction timelines, if housing is not reviewed and approved first by governments, our members cannot build. Both the provincial and local governments share this responsibility. Yet, UBCM’s lack of acknowledgement of its role is concerning. CHBA BC and local HBAs continue to work to implement the Development Approval Process Review (DAPR) report recommendations to improve the process so more housing can be approved.
We need an approval system that allows the homes and jobs - needed today and in the future - to come forward. CHBA BC continues to advocate for policy measures that would see to this. Discussion in this regard continues to take place. Clarification on PST for Fossil Fuel Combustion Systems and Heat Pumps

On Friday, April 1, the new PST rate of 12% on the purchase or lease price of fossil fuel combustion system systems will come into effect, while heat pumps will be exempt from PST
The BC government’s recent notice of the change, Notice 2022-003 - Provincial Sales Tax on Fossil Fuel Combustion Systems and Heat Pumps, was revised this week to:
- Add information about how parts and components are determined to be part of a fossil fuel combustion system or heat pump system
- Add a transitional situation where additional PST would be owing on a fossil fuel combustion system
- Add information to describe what is considered a heat pump
The revised notice includes numerous examples to assist in providing direction to how the Provincial Sales Tax (PST) will apply to fossil fuel combustion systems and heat pumps.

Amendments to the Property Law Act and Creation of a new Homebuyer Protection Period

Amendments to the Property Law Act introduced this week will allow for the creation of a Homebuyer Protection Period, also called a “right of recission” or “cooling off” period.
A new homebuyer protection period is one part of the Province’s efforts to protect people during the home-buying process. The parameters of this new tool, as well as any other new consumer protections to be implemented, will be informed by consultations undertaken by BC Financial Services Authority (BCFSA), with stakeholders including CHBA BC.
BCFSA’s analysis of the consultation is expected this spring with the goal of having protection measures in place by summer.

Employment Standards Act and Paid Sick Leave Legislation Amended

Minister Harry Bains of Labour, has introduced changes to address two issues that have been raised since the five days of employer-paid sick leave came into effect on Jan. 1, 2022. The changes will be effective upon Royal Assent, which is expected before the end of the current legislative session, to ensure the paid sick leave entitlement applies to the 2022 calendar year.
Amendments made include:
- Amending the act to reference “calendar year” as opposed to “employment year” to standardize the annual entitlement period for all employees regardless of the start of employment. This is in response to concerns that the use of “employment year” instead of “calendar year” to establish an employee’s annual paid sick leave entitlement is cumbersome since it requires a separate date for each employee based on the start date of their employment.
- To respond to concerns that some employees were excluded from the full five paid sick days due to existing language in collective agreements, the clause that relates to collective agreements is being amended to ensure government’s intent that the paid sick leave entitlement is applied to all employees in B.C.
