John – In a rarity for them, the Supreme Court made the correct decision a few weeks ago:

CNN:
“Supreme Court denies GOP challenges to congressional maps in North Carolina and Pennsylvania”

But we’re not celebrating just yet, for a couple of reasons.

(1) A few weeks before that, SCOTUS made a terrible decision that allowed Alabama’s 2022 congressional elections to proceed on manipulated maps.

(2) Republicans in many states are promoting a fringe legal theory that could undermine our entire federalist system – and some justices may be willing to consider it in the future.

“The theory, called the ‘independent state legislature doctrine,’ interprets the federal elections clause of the U.S. Constitution to say that state legislatures are the sole power-holders when it comes to federal elections.
That theory could delegitimize the power of the two other branches , from the state supreme court’s jurisdiction when it comes to district maps to the governor’s veto power.”

SCARY! As A.G. Holder said, “Republicans are making it quite clear that they will do whatever it takes – even if it means eroding our federalist system as we know it – to circumvent the will of the people so they can lock in their own power.”
