** What's the best next step reform to follow the First Step Act
------------------------------------------------------------
The libertarian Koch brothers, along with their associates and allies, made common cause with Democrats and even Republicans to pass the First Step Act on December 21, 2018. This legislation, as the name suggests, took a big first step toward reforming the broken U.S. criminal justice system. This is an example that demonstrates multiple things…
* Not everything Congress does is bad.
* Sometimes Democrats and Republicans join together to do good things.
* Good bills can be passed without winning elections.
* It costs a lot less time, money, and effort to pass a bill than it does to win a single election, let alone a majority of congressional seats.
Does this mean U.S. criminal justice is reformed? No. The bill name said it all. It was only the first step.
** Next step reform is still needed
------------------------------------------------------------
Just consider these recent stories...
The FBI seized one million dollars from a family ([link removed]) without filing charges. It took two years and more than a hundred thousand dollars in legal fees for them to get some of the money back. Police will often use asset forfeiture to force innocent people to make plea bargain deals and/or to cripple their ability to fund a legal defense. It gets worse…
Police don't even have to allege that money or property were used in the commission of a crime. They only have to allege that the money or property could have been so used. The property owner then has to prove that the property or money was NOT involved in a crime. Under that standard, everything you own is subject to seizure. Fortunately, a case where police stole more than $100,000 in cash from a woman at the Dallas airport ([link removed]) is inspiring Texas politicians to consider asset forfeiture reform ([link removed]) .
Keep reminding yourself of this fact - sometimes politicians do good things. You and I need to help them do even more good.
Asset forfeiture isn't the only tool that police and prosecutors use to subvert justice. They also use plea bargains to extort people into admitting guilt ([link removed]) and accepting punishment, rather than risk even harsher penalties.
These three examples only skim the surface of all the problems that still need to be fixed. So what should be the Second Step after the First Step Act? There are multiple good candidates...
* We could repeal asset forfeiture. Thirty-six states have already taken steps in this direction (see, good stuff can happen), but federal interference is hampering faster progress ([link removed]) .
* S. 601 is the Prohibiting Punishment of Acquitted Conduct Act ([link removed]) , and it currently has 9 co-sponsors. This bill would end the use of so-called "judicial findings," by which judges sentence people for additional charges that were either acquitted or never tried in court.
* H.R. 1470 is the Ending Qualified Immunity Act ([link removed]) and it currently has 41 co-sponsors. This bill would allow police to be held accountable for their violations of citizens' rights.
* We could restore federal parole ([link removed]) . It simply makes no sense that so many Americans are serving long sentences for federal offenses that shouldn't even exist.
** Be the Agenda Setter for your friends
------------------------------------------------------------
You need to be talking with your friends about all of these examples and issues.
Media chosen issues are practically designed to manipulate your friends and weaken their resistence. Help them break free from media agenda setting!
Set a different agenda by focusing on bad things that can be fixed, some of which already have bills in Congress.
** So which idea is the best next step after the First Step Act?
------------------------------------------------------------
We think restoring federal parole is a good candidate. It would immediately start returning non-violent offenders to their lives and families. It would help shrink the prison population and reduce incarceration costs. It would also make sentences less draconian, This would reduce the power that prosecutors have to extort innocent people into guilty verdicts.
