Dear John,
Soon President Biden will share the name of his pick to replace Justice Breyer on the Supreme Court, and he’s promised to nominate the first Black woman to fill the seat. She won’t just make history—she’ll begin to counter generations of bias, racism, and under-representation that have kept Black women from interpreting the laws that often impact them the most.
But of course—there’s already been backlash. The media has run articles questioning her qualifications. And by “her,” I mean ANY Black woman. Even without a name, they somehow have their doubts. And in recent polls, many people are expressing preference for “the most qualified pick” vs. a Black woman, as if those can’t be the same thing.
It’s infuriating. This should be a moment of joy and triumph as we’re on the precipice of real change at the Supreme Court—but as we know, misogynoir runs deep.
We can’t let the media and those who don’t want Black women to lead get in the way of this historic moment.

I’m not sure if you’ve seen some of the names circulating who are under consideration to replace Justice Breyer, but these lawyers and advocates are some of the most incredible legal minds in our country. Judges. Professors. Civil rights lawyers. Public defenders and prosecutors. And for every name mentioned in media reports as a likely contender, countless more Black women could be named and elevated to a place in our nation's judiciary.
Biden's promise to appoint a Black woman is an effort to break a harmful tradition of defaulting to the perspectives of white men, especially in our powerful courts. President Biden’s nominee will bring not just a diversity of race and gender but also diversity of experience, viewpoint, and jurisprudence that will strengthen the Supreme Court as an institution.

It’s not surprising that so many in our country are resistant to change, especially certain lawmakers and members of the media who cling to their power and privilege so tightly. But we’re going to hold them accountable for their racism and misogyny throughout this confirmation process. And we’ll need you with us. Take action now.
