CONSTITUTIONAL CHALLENGE CORNERS CAWTHORN
This week, after Our Revolution and Free Speech For People filed a legal complaint with the North Carolina Board of Elections to block US Rep. Madison Cawthorn from the ballot for inciting the Jan. 6th insurrection, Cawthorn resorted to begging a federal court for “amnesty” under a law used by ex-Confederates.
As Slate reported this week, “The legal team contesting his reelection has boxed in the congressman so dexterously that he has resorted to an argument of eye-popping gall and inanity: Cawthorn asserts that the Amnesty Act of 1872 - a shameful law that perpetuated white supremacy in the South - absolves him of disqualification from office even if he engaged in an insurrection.”
As FSFP lead counsel John Bonifaz asked, “What’s he so afraid of?” Turns out, quite a bit.
Cawthorn’s actions during and after the Capitol riot provide more than enough “reasonable suspicion or belief” that he “does not meet the constitutional qualifications” under the 14th Amendment, which prohibits any who “engaged in insurrection or rebellion” from holding public office.
Our Revolution NC members - including Dr. Jay Walsh and Claude Boisson - were the first to come forward to challenge Cawthorn's candidacy.
“When I joined the Navy, I swore an oath to defend the U.S. from all enemies foreign and domestic,” Dr. Walsh told us on our National Organizing Call in January. “When I saw Rep. Cawthorn egging on the insurrection, I knew I had no choice. Standing up like this — of course, I have fear, but I have greater fear for the loss of our democracy.”
With the Trump-controlled GOP officially declaring Friday that the violent attack on the Capitol constitutes “legitimate political discourse,” Our Revolution is committed to organizing our members to defend our democracy from the authoritarian right.

BUILDING PROGRESSIVE POWER IN CONGRESS
Progressive candidates for Congress are coming out strong for the 2022 midterms — and Our Revolution members are ready to flip red seats, win open seats, and replace corporate incumbents.
Nina Turner is hitting the ground running in her recently-announced rematch against Rep. Shontel Brown in Greater Cleveland, and Jessica Cisneros has generated a ton of energy around her rematch against Rep. Henry Cuellar in San Antonio/Laredo TX. Jamie McLeod-Skinner is making a second congressional run in Oregon, this time taking on Rep. Kurt Shrader in the 5th District.
“The fight around Build Back Better really clarified who within the Democratic caucus is a progressive and who is not,” Our Revolution Executive Director Joseph Geevarghese told The Hill. “In the case of Kurt Schrader and Henry Cuellar, the contrast is clear and there’s more grassroots energy being generated as a result.”
In 2022, Our Revolution members are drawing a line - any Democrat who undermines the Democratic agenda must be sidelined. Despite what the establishment wing of the Party says against progressive primary challenges, it’s absolutely necessary to change the composition of Congress to deliver for our people, our democracy, and our planet.

KEEPING UNION-BUSTERS OFF THE SUPREME COURT!
Our Revolution is urging President Biden to nominate a pro-labor jurist - not an anti-labor jurist - to fill the vacancy of retiring Supreme Court Justice Stephen Breyer.
“Biden vowed to be the ‘most pro-union,’ ever, and it’s imperative that he keeps this campaign promise by nominating a pro-union Justice,” Our Revolution Executive Director Joseph Geevarghese told the Courthouse News. “It is highly concerning that some Democrats, including Rep. Jim Clyburn, are pushing for the appointment of South Carolina District Court Judge J. Michelle Childs, a former labor and employment lawyer who repeatedly worked on behalf of employers against unionization drives.”
In many cases, Childs represented corporate bosses accused of violating disability law and engaging in sexual harassment.
Larry Cohen, Our Revolution board chair and former president of the Communications Workers of America said there “is widespread concern” in the labor movement about Childs’ record, citing conversations he has had with union leaders this week, the Washington Post reports.
“Her labor record — her years as a management-side lawyer — definitely paint her as somebody who could just as easily be a Republican and certainly has no record supporting workers’ rights,” Larry said. “This is of great concern to many of us. ... She spent years on the wrong side.”
Being on the wrong side has earned Childs the support of the South Carolina business community and Trump-aligned Republican Sen. Lindsey Graham, a member of the Judiciary Committee.
“The fact that Lindsey Graham is vouching for her should give the White House pause. It’s a coordinated campaign. When conservatives take power, they pick the most conservative justices ever. It's not clear, on our side, that we’re picking the most progressive,” Our Revolution Executive Director Joseph Geevarghese told the Washington Post’s Dave Wiegel in an interview.
Our Revolution Communications Director Paco Fabián told CNN: “If she’s getting praise from somebody like Sen. Graham — who was a big supporter of President Trump — that’s not great, in our view. But really it’s about her record.”
Biden’s nomination could lock in a corporate-friendly SCOTUS for a generation at a time when the Court is voting in lockstep 83 percent of the time with the country’s largest lobbying group, the U.S. Chamber of Commerce, representing 3 million corporations.

Meanwhile - on the right side - SCOTUS candidate Judge Ketanji Brown Jackson released her first opinion from the appeals bench this week, ruling in favor of public-sector labor unions challenge to Trump’s order to eviscerate collective bargaining rights. Jackson has previously blocked executive orders from Trump limiting federal workers rights.
