BIDEN ADMINISTRATION CONTINUES ITS WAR WITH FLORIDA OVER MONOCLONAL ANTIBODY TREATMENTS
Last week, Governor DeSantis condemned the Biden Administration’s haphazard decision to revoke authorization of these lifesaving monoclonal antibody treatments. This decision was made solely by Biden’s Food and Drug Administration (FDA) without advance warning to states and health providers and without clinical data to support the decision. The deliberate decision by the Biden Administration to make this announcement effective immediately through a press release actively prevented states and health care providers from making real-time operational decisions to save lives. As a result of this abrupt and clinically unsupported action, the appointments for more than 2,000 Floridians to receive monoclonal antibodies were cancelled.

Two days later, the Governor held a roundtable with doctors and patients who have recently received monoclonal antibodies now banned by the Biden Administration to highlight the real-world clinical success of these treatments.
 
This decision was made without clinical data and without any advance warning to states and medical providers, leaving sick Floridians scrambling to find an alternative treatment,” said Governor Ron DeSantis. “Thousands of Floridians, who were already in the system and waiting to get treatment, woke up to an email saying that these treatments were now prohibited. It is fundamentally wrong and not the way we should treat people in this country. Our view in Florida is that we want doctors to be able to administer this treatment and patients to be able to access it, and they can make their own decisions from there.”
 
“Monoclonal antibodies have been at the forefront of treatment for COVID-19. It is a very well tolerated and scientifically proven treatment against the virus,” said Dr. Kenneth Sheppke, Deputy Secretary, Florida Department of Health. “The value of monoclonals cannot be understated in the ability to treat people with this disease. We have two pieces of conflicting data; we have this study on cells that suggests it might be less effective against Omicron and we have real world experience in humans where we have seen really excellent outcomes. Floridians and the rest of the nation have come to expect the availability of these treatments and it is really important for us as physicians to have those tools at our disposal to make the decisions on what treatment is best for patients.”
 
“We have been studying the monoclonals to see if it actually does what it says. We published our first paper that found that the monoclonals had an amazing reduction on hospital admissions,” said Dr. David Farcy, MD Chairman, Department of Emergency Medicine at Mount Sinai Medical Center. “In the course of six weeks, we had an estimated 1000 patients that received monoclonals. Out of those 1000 patients that were considered high risk, we only had single digits of patients that came back that needed to be admitted to the hospital, less than 5%. We are not here to say that one is better than the other, we need prospective data, meaning we need data to be studied forward.”
 
“I was disheartened to tell 18 patients we could not give them my typical medication when I woke up to find out the FDA had pulled the EUA for the medications I use the most for my COVID patients,” said Dr. Dwight Reynolds, MD, ABEM, FACEP, Medical Director and Owner, Centers for Health Promotion, Inc. “I gave one patient Regeneron and she thought I was someone special, she was feeling so much better after getting treatment. I have treated approximately 200 patients over the last two weeks in my practice in Coral Springs. Out of 200 patients – I personally called the next day – they have had absolutely no problem with the medication, and they all are doing well.”
 
“I tested positive, and I immediately had the treatment scheduled for the next day. Within 20 minutes of my appointment time, I had already had the treatment, gone home, and went on with my day,” said Scott Fortney, realtor and monoclonal treatment patient. “The next morning, I woke up and felt better, and another 24 hours later I woke up and I could breathe. I can say without fail I felt so much better, had more energy, went to my desk working, and felt better without doubt. My roommate, who tested positive, elected not to take the treatment, and to this day she feels terrible. My biggest fear is that this option wouldn’t be available to her. This is an option that’s not harming people, let’s give them a choice. Let them make that choice with their physician.”
 
“A week ago, I started feeling sick, it was so rapid it was scary, and just feeling horrible,” said Nancy Schlotter, cancelled monoclonal treatment patient. “I couldn’t believe it was happening so quickly, and the next morning I tested myself and it was positive. I was feeling worse and worse. I didn’t know what to do but I knew these mAbs were available. I still don’t have taste or smell and wish I had the treatment but thank you for trying to provide this to those of us who may need it.”
 
“We had a plan and feel healthy for our age, but we were holding out for the mAb treatment if we were to get sick,” said Frank Schlotter, cancelled monoclonal treatment patient. “When we tested positive, not knowing how sick we were going to get we signed up for the treatment and were blindsided when the appointments were cancelled. We’re fortunate to start feeling better but we were really disappointed when there was short notice cancellation.”
 
Governor DeSantis is demanding the Biden Administration reverse its sudden and reckless decision to revoke emergency use authorization (EUA) for Regeneron and Eli Lilly monoclonal antibody treatments.

ALONG WITH OTHER STATES FLORIDA SUES BIDEN ADMINISTRATION ON ILLEGAL ACTIONS AT THE BORDER


Florida joined states from across the nation, including Texas, Indiana, Missouri, Montana, Oklahoma, Arkansas, and Alaska in filing suit against the Biden Administration for reinstating the Central America Minors (CAM) Program. “The Biden administration continues to disregard the laws of this country and allow massive numbers of illegal aliens across the border, without regard to possible criminal backgrounds or connections to illicit activity,” said Governor Ron DeSantis. “Not only are these illegal aliens allowed free reign in this country, but the administration also pushes the burden and costs onto the states and ignores the consequences of its policies. I’m glad that Attorney General Moody is helping to block the reckless immigration policies of the Biden Administration.”
 
“After seeing the chaos in person, it is even more clear to me now that Biden and Mayorkas are building their own illegal organization to transport illegal immigrants into and around our country – thumbing their noses at federal laws,” said Attorney General Ashley Moody. “I will not only work aggressively to stop these illegal acts, but I will continue to inform Floridians about what their federal government is actually doing, and the dangers associated with those decisions.”
 
“The Biden Administration’s open border policies are disastrous and creating a human trafficking and child sexual exploitation crisis,” said Lieutenant Governor Jeanette Nuñez. “By filing this suit, we are holding the federal government accountable for refusing to enforce the law and secure our borders, which puts every Floridian at risk.”
 
The CAM program is a brazen abuse of the Federal Government’s parole authority. It allows foreign nationals from the Northern Triangle – El Salvador, Guatemala, and Honduras – many of whom are already in the country illegally, to bring their children (including adult children up to the age of 21) and other family members into the country, even if they do not qualify for asylum or refugee status. The Federal Government’s parole authority is only meant to be exercised on a case-by-case basis for urgent humanitarian reasons and significant public benefit. Granting broad based parole without individualized findings is a blatant violation of federal immigration law. This illegal program should be terminated immediately.

GOVERNOR HAS ADVICE FOR BIDEN ON SUPREME COURT PICK


Gov. Ron DeSantis called for President Joe Biden to pick a Supreme Court justice who will be "faithful to the law and Constitution."

DeSantis made his comments on Friday during a press conference, according to Florida Politics.

"When you’re dealing with picks for the Supreme Court, you want people who are going to be faithful to the law and the Constitution and understand how our constitutional system was designed to have separate powers," he said.

"The job of the judicial branch is to apply the law and Constitution. It's not to rewrite the law and Constitution. Judges who understand that … have a certain amount of humility to understand the proper role. Doesn’t mean you can’t be active in deciding cases properly before you, and if you have to come down on the constitutional side, you have to do it and do it forcefully."

"But you’re not a philosopher-king. And you’re not hovering over the entire political system and basically being a super legislator."

Biden has vowed to nominate the first Black woman to the high court to replace retiring Justice Stephen Breyer. He is expected to name a replacement by the end of February



GOVERNOR AND RUBIO ENDORSED BY LAW ENFORCEMENT


Last week Governor Ron DeSantis received the endorsement for re-election from 58 (of 67) Florida sheriffs and the Florida Police Chiefs Association (FPCA) which asserted “the Republican has “always had our back.” Senator Marco Rubio also received the endorsement of 55 of Florida's sheriffs.

This week the attorney general issued a Consumer Alert with some alarming news about a rise in jury duty scams in Florida.
Reports of jury duty scams have surfaced in at least five Florida counties in the past year—two of those warnings coming in this month alone.
Scammers are calling targets claiming they missed a jury duty report date and must make immediate payment to avoid going to jail, even though failure to appear for jury duty is not grounds for immediate arrest.
Court officials will also never demand payment over the phone or ask that payment be wired or made through a gift card.
There are few civic duties as important to our judicial system as serving on a jury. As a former judge, she said she was livid that anyone would exploit this honorable process to scare citizens into paying a ransom.
Below are several tips to guard against jury duty scams:
  • Know that jury duty summons will only come by mail.
  • If no jury duty summons is received, then ignore a phone call from anyone claiming to be calling about jury duty.
  • Never give personal or financial information over the phone to a stranger, especially if the caller acts aggressively.
  • Be wary of Caller ID, as this can be spoofed, making a phone call look like it is coming from a real source.
