Hours ago, the Pennsylvania Commonwealth Court ruled against voting by mail and declared Act 77 unconstitutional.

We expect that this decision will get appealed, which means that voting by mail can continue until it’s decided by the Pennsylvania Supreme Court.

Lawmakers in BOTH parties passed the vote by mail law by huge margins. But the minute it became clear that mail-in voting hurt their candidates, some legislators who helped pass the vote-by-mail law reversed course and filed this lawsuit to get it thrown out.

Making it harder for people to vote is all part of the nationwide far-right playbook to swing elections. And this lawsuit is only one prong of the strategy. We’re fighting dozens of bills that are designed to make it so burdensome for voters — particularly low-income, people of color, and young people — to vote that they stay home.

Our strategy is to work round the clock monitoring these bills, working with our allies to keep up the collective support for efforts to broaden our democracy, holding meetings with key lawmakers, and mobilizing our base of grassroots supporters through more texts, more emails, and more paid ad campaigns.

But all of this is going to take a tremendous amount of resources, which is why we’re asking for your help today.

Make no mistake — today's ruling is an attack on Pennsylvanians' voting rights. Mail-in voting is a legal, popular, and secure way to vote in Pennsylvania, and we’re going to fight like hell to make sure rights like these stand.

But it’s not the only threat we’re facing. We told you about HB 38 just a few days ago — a bill that would gerrymander our state courts and rob Pennsylvania voters of their ability to elect and provide a check on these judges. We effectively stalled this attack on our democracy for now, but we expect it to be back on the table soon — along with dozens of other attempts by far-right lawmakers to block environmental progress and voting rights.

We can block attacks on our right to vote, but it takes significant resources to educate and mobilize in key communities and keep the pressure on state lawmakers. We’re counting on members like you to help fund this fight.
