Twelve years ago last week an ultra-conservative majority on the Court stepped up its attacks on our democracy with their ruling in the case Citizens United v. FEC.

That decision opened the floodgates to huge sums of outside money, including dark, undisclosed money in our elections. That decision and ones that followed is why we so desperately need concrete regulation of dark money and a robust small donor funded campaign finance system. The insurrectionists who violently attacked the U.S. Capitol building on January 6, 2021 were motivated by the former president’s Big Lie that he won the election but that his victory was somehow stolen from him.

That lie has been debunked over and over again by journalists and election officials, both Republicans and Democrats – and by the courts. But it has never been abandoned by Trump or his right-wing allies. And so one year after it fueled an attack on Congress and the Constitution, the Big Lie is still a huge threat to our democracy.

We need a justice for all.

With the just-announced retirement of Justice Breyer, we have a once-in-a-lifetime opportunity. President Biden has made it clear that he will appoint to the Supreme Court an eminently qualified individual, with a demonstrated commitment to civil rights, who will bring to the Court her unique perspective as a Black woman. This continues his record of nominating superbly qualified and diverse nominees with a demonstrated commitment to upholding the rights of all Americans.

President Biden has indicated his plans to make a nomination by the end of February and we urge the Senate to move expeditiously to confirm the historic nominee, who will be the first Black woman Supreme Court justice. In making this nomination, President Biden will be drawing from the extraordinary pool of brilliant and skilled women who during their careers have demonstrated their commitment to ensuring equality and justice for all.
