Yesterday, Supreme Court Justice Stephen Breyer announced his retirement, giving President Biden the opportunity to fulfill his campaign promise of nominating the first Black woman in the history of the Supreme Court.
But while we don’t yet know who the pick will be, we do know that Mitch McConnell will pull every trick in the book to stop her — and we know that she will face relentless attacks from Fox News and the right-wing media.
Remember how ruthless Republicans have been when it comes to the Supreme Court.
They blocked Merrick Garland’s nomination for 8 months, changed the rules of the Senate to ram through the confirmations of Brett Kavanaugh and Neil Gorsuch, and then, when Ruth Bader Ginsburg passed away, confirmed Amy Coney Barrett just eight days before the election when 65 million people had already voted.
So expect the right to attack with everything it has, no matter who is nominated.
America hasn’t been this divided since the Civil War. And ever since Ronald Reagan started the process of packing the Court with far-right idealogues, Supreme Court appointments have provided a vehicle for the most extreme and bitter forms of partisan warfare.
And as if that’s not enough reason to worry, remember that with the current 50-50 split in the U.S. Senate, we can’t afford to lose a single Democratic vote. Not Kyrsten Sinema, not Joe Manchin. No one.
