Yesterday, we learned that Supreme Court Justice Stephen Breyer plans to retire this year. His departure from our nation’s highest court will leave a hole that must be filled without delay.
I've known Justice Breyer since he served as a counsel on the Senate Judiciary Committee, and I want to thank him for his service to our nation and the rich legacy he will leave behind.
Significantly, Justice Breyer will be remembered for his fierce guardianship of the Constitution as well as his genuine desire to forge friendship and common ground across party lines. When he retires, my colleagues in the Senate must fulfill our Constitutional duty and quickly consider President Biden's nominee to fill his vacancy.

In these unprecedented times, it has never been more important for us to have a complete court to consider the critical issues facing our country.
The process by which Supreme Court justices are considered by the Senate must return to normal order and not be tainted by politically motivated obstruction, as we saw with Merrick Garland's nomination in 2016.
With the possibility that bad actors in the Senate will pull out their old antics, we must speak out – starting today – about the importance of not obstructing this process.
