On January 26, Supreme Court Justice Stephen Breyer announced he would
retire at the end of his term.

This will be President Biden’s first chance to nominate a justice to the
highest court in the country. His choice could influence the legacy of his
presidency and the still lacking diversity of the Court for decades to
come.

The Supreme Court is increasingly taking on cases with climate
implications: from reviewing Republican challenges to the Clean Air Act,
the status of oil and gas leasing, the EPA’s ability to curb carbon
pollution, and more. It’s crucial that President Biden put forward a Black
woman nominee who will prioritize climate justice and not give in to
corporations and Big Oil.

In a press conference, President Biden affirmed that he is committed to
keeping his promise to put the first Black woman on the Supreme Court — a
historic step towards a more equitable court when 108 of the 115 justices
to serve on the Court have been white men.

With the ability for justices to serve life terms and a 50-50 split in the
Senate, we don’t know if President Biden will get another chance to
appoint a nominee to SCOTUS.

President Biden must meet this moment by nominating a Black woman and
climate champion as soon as possible, and the Senate must confirm them
expeditiously — there’s too much at stake to wait.
