Every citizen’s vote is sacred. If we expect to have a government, of the people, by the people and for the people, then we must do all we can to ensure a fair and secure election process. Here in Hawai’i we should especially be focused on pressing our state legislators to ensure that it is easy to vote, but hard to cheat. As many of you know, in February of 2021, our Republican National Committee Chairwoman Ronna McDaniel announced the formation of a new Committee on Election Integrity dedicated to restoring election transparency.

State Litigation Highlights

Arizona
A lawsuit, Mi Familia Vota et al v. Hobbs et al., was filed in AZ challenging SB1485, which removes voters from the permanent mail ballot list if a voter does not vote by mail in two straight election cycles, and SB1003, which requires voters to “cure” signature-less ballots by 7PM on election day. The RNC and the NRSC were granted intervention to defend the laws. Defendants filed a motion to dismiss on November 18.
Florida
The RNC and NRSC were granted intervention in all four lawsuits challenging provisions of SB90. Judge Walker entered orders granting in part and denying in part defendants’ motions to dismiss. The court dismissed the claim challenging ballot harvesting provisions based on lack of standing. On December 17, the court denied all motions for summary judgment in the cases and set a trial date of January 31, 2022. The trial will be held virtually.
Georgia
The RNC, NRSC, NRCC, and GA GOP were granted intervention in eight lawsuits, including the U.S. Department of Justice’s lawsuit against the state, challenging provisions of ** SB202. ([link removed])
Previously, the court denied motions to dismiss for lack of standing and on the merits, filed by the RNC, other Republican organizations, and Republican lawmakers in Georgia in eight of the lawsuits. In December, the court denied the Motions to Dismiss filed by the State, RNC, RNSC, RNCC, and the GA GOP. The RNC, NRSC, and GA GOP have also moved to intervene in a ninth lawsuit also challenging provisions of SB202 which is still pending.
Iowa
The RNC, Iowa GOP, NRCC, and NRSC were granted intervention to defend against a lawsuit challenging provisions of ** SF413 ([link removed])
and ** SF568 ([link removed])
. The trial is set for March 14, 2022.
Nevada
In December, Marc Elias filed a lawsuit seeking to block a proposed ballot initiative “Nevada Voters First” that would create open primaries and institute ranked-choice voting for general elections. The court rejected Elias’s plaintiff’s challenges to the ballot initiative and entered a final judgment against the plaintiff. The order can be found ** here ([link removed])

New York
The RNC and NY GOP, leading a broad bipartisan coalition of officeholders and concerned citizens, including Congresswoman Malliotakis and naturalized citizen voters,** sued Mayor Eric Adams, the New York City Council, and the New York City Board of Elections ([link removed])
in state court for illegally allowing noncitizens to vote in city elections. The complaint is available ** here ([link removed])
. The NYC Board of Elections has since ** requested ([link removed])
that the state review the law and issue an opinion on its legality.
The “Non-Citizen Voting Law” was passed by the New York City Council on December 9, 2021 and became law when Mayor Adams failed to veto the legislation. The law purports to give over 800,000 New York City non-citizens the right to vote in local municipal elections. This is much ** larger than the margin ([link removed])
in last year’s New York Mayor Democrat primary, meaning these non-citizen votes could have swung the race to another candidate.
The lawsuit argues the Non-Citizen Voting Law is unconstitutional and violates Articles II and IX of the New York State Constitution, state election statutes, and the state’s Municipal Home Rule Law.
* Multiple provisions of the New York State Constitution and election statutes explicitly require voters to be citizens.
* Specifically, Article II, Section 5 of the New York State Constitution provides, in relevant part, that “laws shall be made for ascertaining, by proper proofs, the citizens who shall be entitled to the right of suffrage hereby established, and for the registration of voters.”
* Likewise, Section 5-102(1) of Chapter 17 of the Laws of New York, states: “No person shall be qualified to register for and vote at any election unless he is a citizen of the United States.”
North Carolina
The trial in the federal NC voter ID case has been put on hold by the trial judge until the U.S. Supreme Court decides if the GOP legislators can intervene in the case. The U.S. Supreme Court granted a writ of certiorari to determine whether GOP legislators in NC have a right to intervene in a case to defend SB824, which requires in-person voters to show photo identification. Previously, the 4th Circuit en banc panel affirmed the lower court’s order denying intervention, holding that the lower court did not abuse its discretion by denying permissive intervention or intervention as of right. The en banc court was nearly evenly divided. There is also pending litigation in state court challenging the photo ID law. The RNC filed an Amicus in support of the GOP Legislators. Pennsylvania
In July, a member of the Bradford County Board of Elections filed a lawsuit against the State of Pennsylvania challenging Act 77, which made sweeping changes to PA's election law including allowing no excuse vote by mail. The lawsuit argues that Act 77 violates the PA Constitution. In October, the DNC and multiple Republican groups were granted intervention.
Republican David Ritter, a candidate for Judge of the Court of Common Pleas of Lehigh County, appealed the Lehigh County Board of Election’s 3-0 decision to count 261 challenged mail-in ballots that were undated or improperly dated. On November 30, 2021, the Court of Common Pleas of Lehigh County denied Ritter’s appeal and ordered the Lehigh County Board of Elections to include the 261 mail-in ballots in its canvass. The case was then appealed to the Commonwealth Court and briefs were filed by the parties on December 8. In a 2-1 ** decision ([link removed])
, the Commonwealth Court reversed and remanded the case concluding that the 257 ballots that do not contain a date must be set aside and not counted in the Municipal Election. Democratic candidate Zachary Cohen ** filed an appeal ([link removed])
with the Pennsylvania Supreme Court.
Texas
The ** U.S. Department of Justice (DOJ) ([link removed])
** sued ([link removed])
the State of Texas and the Texas Secretary of State challenging certain provisions in the recently enacted election integrity bill: SB1. The DOJ claims that the law violates Section 208 of the Voting Rights Act and Section 101 of the Civil Rights Act. The RNC, NRCC, NRSC, and Dallas and Harris County Republican Parties moved to intervene in the DOJ suit and others challenging SB1. The court denied the party committees’ motion to intervene and the party committees promptly ** appealed ([link removed])
the ruling to the 5th Circuit Court of Appeals. The Department of Justice is actively opposing the party committees’ intervention. Oral arguments are set for the week of March 7.
Vermont
The ** RNC sued ([link removed])
the cities of Montpelier and Winooski over their new town charters that allow non-citizens to vote in their municipal elections. The lawsuit also raises important concerns about how the laws will be implemented and whether non-citizens will end up on the same voter registration lists used for state-level and federal elections. The RNC is joined in the suit by the Vermont Republican Party and several concerned Vermont voters.

, Vermont’s Republican governor vetoed the legislation.

Motions to dismiss have been filed in the case and the state of Vermont moved to intervene to defend the charters. The RNC filed its opposition to the motion to dismiss on January 21, 2022.
Virginia
The Democratic Party of Virginia and the DCCC ** sued members of the Virginia Board of Elections ([link removed])
over the state’s law requiring voters to disclose their social security number when registering to vote. The Democrats allege the registration requirement violates the First and Fourteenth Amendments and the federal Privacy Act. The lawsuit also challenges the state’s absentee ballot curing process arguing that the deadline by which voters receive notice of defects of their absentee ballots is arbitrary. The Republican Party of Virginia and the ** Public Interest Legal Foundation ([link removed])
have moved to intervene as defendants.
Wisconsin
In ** Teigen v. WEC ([link removed])
, the WI Circuit ** ruled that absentee ballot drop boxes are not permitted under Wisconsin law ([link removed])
and ordered the Wisconsin Elections Commission (WEC) to retract its instructions on the use of drop boxes. The WEC is ** appealing ([link removed])

for the Feb 15 primary while the Defendants pursue an appeal.

RNC CHAIRMAN RONNA MCDANIEL: I will say, I know what Stacey Abrams conflict is: It is Biden’s very bad poll numbers. She doesn’t want to be seen with him anywhere in the state of Georgia. Listen, this is a total overreach by the left. It is so hypocritical to hear the left talk about vaccine mandates. You can't go to a restaurant without showing your vaccine card, but they want to strip away showing your ID to vote - which 80% of the American people agree with according to NPR. This is something that most of us think should happen just to make sure our elections are secure. They are overreaching here. Joe Biden is in Georgia; he should actually be in New York where they just allowed non-citizens to vote in elections. Maybe he should be fighting that instead.

RNC Chairwoman Ronna McDaniel Releases New Episode of “Real America” Podcast Featuring House Minority Whip Steve Scalise

“It is so critical to realize it's not incompetence. This is intentional. This is their worldview. Biden does not want a stronger America. He is running our country, and the policies he's putting in place are intentional,” said Chairwoman McDaniel. “They like to blame COVID for everything. But not everything is COVID’s fault. When you shut down our energy producing ability in this country, it's why gas prices are up, and I think the American people are getting it.”
“If pipelines were bad, why did Biden kill the Keystone Pipeline, but then turn around and green light the Nord Stream 2 pipeline between Russia and Germany?,” questioned Scalise. “It's American jobs he is going after and he is hurting our country.”
In the podcast, Chairwoman McDaniel and Whip Scalise discussed the importance of getting out to vote and how Republicans are leading the fight for election integrity.
“Nobody has an excuse to stay at home. We need people out voting and when they go out voting, also making sure that they're protecting the integrity, the voting system, you get the right outcome. And we saw that in Virginia. We're going to take that model on the road too, and it helps people to remind them, look at what they did in Virginia,” said Scalise. “Everybody's got a vote and we fight for that right for everybody to vote.”
“The only vote that doesn't count is the one you don't cast,” said Chairwoman McDaniel. “In Virginia, the RNC was the key and we had 3,500 shifts of poll watchers before the election, during the 45 day early voting period. We had 500 lawyers on the ground, and we had 98 percent coverage of polling locations from volunteers.”

National Poll Worker Recruitment Week
* A Poll Worker is an individual who works inside a polling location for the local elections office during early voting and/or on Election Day.
+ Individuals must be trained by the local elections office on their specific role.
* There is a severe shortage of election and poll workers throughout the country.
* Poll workers increase confidence in the election process by ensuring elections are free and fair of any election related irregularities, violations, and disruptions.
* National Poll Worker Recruitment week is a great opportunity to engage citizens who want to ensure transparency in our elections.
* For the RNC, every week is poll worker week – we have made significant investments in ensuring election integrity nationwide.
* From 1982 to 2019, the RNC was prohibited from taking part in poll-watching and other election monitoring activities due to a consent decree filed by the DNC.
+ This meant we were unable to actively take part in election integrity, from boots on the ground to legal efforts.
* The decree’s removal in 2019 allowed us to begin building an election integrity operation, which now leads the way for the entire Republican ecosystem.
* We have hired fifteen election integrity directors in key states and twelve election integrity state counsels.
+ Election integrity state directors are tasked with recruiting and training election integrity volunteers to poll-watch, collaborating with state parties and local stakeholders, and promoting best practices for fair, secure elections.
+ Election integrity state counsels are tasked with providing counsel to the state directors, submitting public information requests, recruiting and organizing volunteer attorneys, and assisting in initiating strategic litigation.
* Our recent efforts in Virginia’s November election proved the effectiveness of our program.

+ We held over 50 poll-watching trainings with over 3,200 attendees.
