The City of San Jose has gone full looney-tunes with the City Council set to vote TOMORROW (Tuesday, January 25th) on a mandatory new gun tax plus AND a requirement for all gun owners in to carry liability insurance. Sometimes the 9th Circuit gets it right and last week, the court’s 3 judge panel ruled that two California counties violated the Constitution’s right to keep and bear arms when they shut down gun and ammunition stores in 2020 as nonessential businesses during the coronavirus pandemic. Gun stores and churches were closed, having been determined to be “non-essential” but those cannabis stores were able to stay open! GOC was instrumental in getting the government to reverse the statewide decision but local officials persisted and had separately won lower court decisions saying gun stores were not exempt from broader shutdown orders. Further court action will be forthcoming, but this is good news nonetheless.
