On Monday, my team at America First Legal filed a lawsuit against the New York State Department of Health over its racist and unconstitutional directive that instructs health-care providers to ration life-saving medical treatments for COVID-19 based on the race of the patient.
Under this hard-left “woke” policy, health-care providers in New York must treat being non-white or Latino as an automatic risk factor when determining eligibility for life-saving medical treatment! Meaning, two individuals who have all of the same risk factors–but one of whom is white and one is not–will be treated differently when determining eligibility for medical treatment.
New York is asking those who we entrust with life and death decisions to ignore years of training in order to further a racist social agenda. This pernicious and twisted public policy cannot go unchallenged or ignored, as the hard left ideologues hope it will be, or else it will spread insidiously throughout the country and into every feature and facet of national life.

This racist directive is outrageously illegal, unconstitutional, and tyrannical. And that is why we are suing the state—because right and justice and morality urgently demand that we act.
