News and Updates Waukesha Judge Rules Absentee Ballot Drop Boxes, Ballot Harvesting Illegal Under State Law Waukesha County Circuit Court Judge Michael Bohren issued a summary judgment decision, in court, that absentee ballot drop boxes and ballot harvesting are not permitted in state law. Judge Bohren also ruled that the Wisconsin Elections Commission (WEC) guidance documents on absentee ballot drop boxes, issued in 2020, should have gone through the rules process. WILL filed a lawsuit on behalf of two Waukesha County voters in June 2021 challenging the legal status of absentee ballot drop boxes after WEC issued unlawful guidance to clerks, in 2020, encouraging the use of absentee ballot drop boxes, and telling voters that anyone else can return their ballot for them. Read More Wisconsin Supreme Court to Hear Parental Rights Case Challenging Madison Schools Gender Identity Policy The Wisconsin Supreme Court granted a petition for review in Doe v. MMSD, a WILL and Alliance Defending Freedom (ADF) lawsuit on behalf of a group of parents challenging a Madison Metropolitan School District’s (MMSD) gender identity policy that violates the rights of parents to make important healthcare decisions on their children’s behalf. WILL and ADF filed the lawsuit in Dane County Circuit Court in 2020 after MMSD adopted policies that allow children of any age to transition to a different gender identity at school without parental consent and even instructed district employees to deceive parents about the transition. Read More WILL Urges Governor Evers to Abandon Race Discrimination in New Housing Assistance Program WILL attorneys issued a letter to Governor Tony Evers urging changes to the implementation of a federal housing assistance program administered by the state of Wisconsin. WILL is concerned that the “Wisconsin Help for Homeowners” program, a $92.7 million fund created by federal COVID-relief legislation, includes unconstitutional racial classifications that would provide housing grants with racial eligibility requirements.
