| The 5th Circuit Court of Appeals in New Orleans (this appeals court governs the states of Texas, Louisiana, and Mississippi) heard the Texas Heartbeat Law oral arguments on January 7th at 9:00am, that discussed a narrow issue in the Texas Heartbeat Law case. The U.S. Supreme Court remanded this portion of the Texas Heartbeat Law case, on December 16th, to the 5th Circuit U.S. Court of Appeals after upholding the Texas Heartbeat Law. The Supreme Court ruled that the abortion businesses could not bring suit against Attorney General Ken Paxton, state-court judges, state-court clerks, and other individuals. The Court's decision from the hearing that occurred on January 7th will determine whether a few other government officials and agencies can be sued under the Texas Heartbeat Law, even though the law make its clear that the Heartbeat law does not involve government officials and that it can only be enforced by private citizens through civil court cases. | | | | U.S. Supreme Court Blocks Biden Vaccine Mandate for Employees Yesterday morning, in a 6 to 3 vote, the U.S. Supreme Court halted enforcement of President Biden's unconstitutional vaccine mandate for employers with over 100 employees, saying that the Occupational Safety and Health Administration (OSHA) is authorized to set workplace safety standards, not broad public health measures. Jonathan Saenz, Attorney & President for Texas Values released the following statement: “As we predicted, the "no jab, no job" policy is unconstitutional and now illegal. Employers should immediately ignore the federal government on vaccine mandates. Let people work." Texas Values, along with leaders and representatives from 29 other states, led a coalition of state family policy council organizations from across the country in opposing the illegal Biden employee vaccine mandate by filing a legal amicus brief at the U.S. Supreme Court. The case, brought by a union of states and business industry groups, and supported by Texas Values, challenges the OSHA nationwide vaccine-or-testing rule for U.S. businesses with 100 or more employees. In addition to Texas Values, family policy organizations (representing entities from 29 other states) signed on to the legal brief as amici curiae. |
