Recently, the State of New York released what seemed to be good news for citizens worried about dying from COVID-19 or who were at risk of being hospitalized with severe symptoms from SARS-CoV-2 infections: two life-saving oral antiviral therapies were now available and authorized for use in New York by the New York Department of Health.
However, there is a shocking twist…
New York State was only offering these two oral antiviral and monoclonal antibody treatments to those who met specific criteria, those who: tested positive, were above a certain age and weight, could start treatment within five days, and had a certain risk factor. One risk factor was being of “Non-White Race.”
As the New York Department of Health statement noted:
“Non-White Race or Hispanic/Latino ethnicity should be considered a risk factor, as longstanding systemic health and social inequities have contributed to an increased risk of severe illness and death from COVID-19.”

America First Legal has demanded that the New York State Department of Health rescind their blatantly racist, unconstitutional, and corrupt policies that direct the rationing of medicine based on race. Their prioritization scheme for the treatment of patients who identify as non-white or Hispanic/Latino ethnicity will result in the denial of life-saving treatment to constituents who do not fall under these racist requirements.
Think about it this way: if the State—with all of its immense coercive power, including the power to bankrupt, to seize property, and to jail—can now decide matters of life and death based on race, then everything we have come to believe about our liberties, everything we have relied upon, is obliterated. It is the path of tyranny and misery and unlimited government power—we must turn back now and rejoin the path of civilization.
That’s not all - this week our team filed a new lawsuit against the Biden Administration on behalf of a courageous federal employee who is being threatened with termination for “misconduct,” simply because she has refused to submit to Biden’s and unconstitutional federal employee vaccine mandate.
