Factory farms are a major source of water pollution in Idaho and across the country. These large-scale industrial operations confine thousands of animals and generate huge amounts of waste. Untreated manure from factory farms is overapplied to cropland, where it seeps into our waterways and drinking water. Factory farm pollution makes people sick.
The Clean Water Act is supposed to protect our water. It requires polluters — including factory farms — to follow strict permits limiting pollution; polluters must comply through testing and public reporting. But the Environmental Protection Agency (EPA) has been illegally carving out a dangerous exception for factory farms, issuing them permits with no water monitoring.
When EPA let factory farms in Idaho off the hook, we took it to court. And we won!
The U.S. Court of Appeals for the Ninth Circuit struck down EPA’s reckless approach to regulating factory farm water pollution. This means that polluting factory farms in Idaho will now have to comprehensively monitor and report on water pollution for the first time. More importantly, the precedent should apply to factory farms across the country.
With this win, we struck a major blow against the EPA’s practice of granting illegal exceptions and special treatment to the factory farm industry. We’re already working to use this win to hold factory farm polluters accountable everywhere.
