Saving the Courts, Saving Lives

Dear John,

Many positive things are happening with conservative nominations to our nation's courts. But I needed to alert you to how critical these next few months are to stop threats which could undermine our values and destroy the America we love.

As of late October, President Trump has had 157 of his judicial picks confirmed and seated on courts across America. That includes 43 judges in the important Circuit Courts of Appeals--the level just below the U.S. Supreme Court.

Keep in mind: conservatives don't want activist judges on any court. The Constitution calls for judges to fairly interpret the written law, not create new ones out of thin air.

It's not just the headline-grabbing Supreme Court picks that matter. Lower federal courts are deciding important cases every day, and FRC works overtime to inform you on cases that impact your life and liberties.

Even liberal media outlets that often disparage President Trump admit how sharp he has been on court nominations. One recent story from PBS Newshour quoted American University law professor Amanda Frost. "He's been remarkably effective and efficient, especially in his appellate court appointments," she said.

For constitutional conservatives like you and me, there's an important question to consider. With this many open judicial seats being decided, is it possible that a judge who is hostile to our liberties could slip through?

The answer isyes, and this is exactly why FRC's work informing leaders in the U.S. Senate is so crucial. A lifetime appointment on a federal bench is no time to play the odds. If the Senate is wrong, countless Americans could pay for it.

One example of this played out when the Trump administration announced attorney Michael Bogren as their pick for a lower court seat in Michigan. He had the support of many Republicans and even Michigan's two Democratic Senators, so it looked like a sure thing.

With religious freedom under unprecedented attack, conservatives must draw a bright line--and, as it turns out, this lawyer had crossed it.

As an attorney, Bogren made the mistake of using the Left's playbook to attack Christians. He defended the city of East Lansing, Michigan for booting a Christian family from their farmers' market. In arguing the case, he smeared the family as "haters."

Bogren actually compared the Catholic couple to the KKK for following church teachings on marriage! FRC raised concerns on Capitol Hill. Senator Josh Hawley (R-Mo.) questioned the attorney about his smears in a heated hearing... and Bogren doubled down on his words.

This was unacceptable, and FRC got to work.

We sounded the alarm about this nomination, starting with a letter soon signed by other conservative groups. I invited Senator Hawley on FRC's daily radio show "Washington Watch," to inform our millions of listeners nationwide.

"Tens of millions of Americans believe what the Tennes family believes about marriage," said Hawley. "The right to religious free exercise enshrined in the First Amendment is the fundamental freedom, and we need judges who will uphold it."

Two other Republican Senators soon went on the record against the Michigan attorney, who ultimately withdrew himself from the nomination in June.

In the heat of this past summer, not many Americans were focused on federal judges--but FRC was, because these appointments matter for your rights and liberties.

We applaud the Trump administration for most of their nominees, but FRC is not here to rubber-stamp their every move. We'll vocally disagree with our allies when the evidence warrants it.
