While we fight to place judges on the bench, AFJ will not lose sight of the other threats facing our courts. Because the Supreme Court still stands at a 6-3 conservative majority, any progress we want to make will face a hostile Court that is more than happy to let unconstitutional laws stand.
One of our primary focuses is fighting the shadow docket [[link removed]] . In recent years, the conservative majority has weaponized its procedures, traditionally used to handle uncontroversial issues, to enact a radical agenda. These decisions come down, without the full Court — or the public — having properly heard the merits of a case. In just the last few months, the Court:

Refused
to
block
a
ruling
in
Texas’s
lowest
federal
court
forcing
President
Biden
to
reinstate
former
President
Trump’s
unlawful
“remain
in
Mexico”
policy;
*
Ruled
to
end
the
nationwide
eviction
moratorium
enacted
during
the
COVID-19
pandemic;
and
*
Greenlit
Texas’s
unconstitutional
SB8
law
banning
abortions
after
six
weeks.
There is only one solution to stop these abuses: Court Reform . AFJ has studied and lobbied for:

Supreme
Court
expansion;
*
Increased
scrutiny
and
limited
use
of
the
shadow
docket;
and
*
An
enhanced
judicial
code
of
ethics
that
applies
to
all
Article
3
judges,
including
the
justices
of
the
Supreme
Court.
