This week, for the 10th time in our history, IJ lawyers stood before the nine justices to defend constitutional rights at the U.S. Supreme Court.
Like our other landmark cases, Carson v. Makin defends vital principles of individual liberty: In this case, we fought for our client families’ ability to ensure their children receive the education that suits them best. While it’s somewhat perilous to make predictions based on oral argument, we are optimistic that the Court will rule for the families and IJ. A majority of the justices appeared to agree with our core argument, that Maine’s current law prevents some families in the state’s school choice program—but not others—from freely choosing their child’s school.
Arguments in this case also reflected a major theme that undergirds all of IJ’s work, from property rights to government accountability to economic liberty: Everyone deserves equal protection under the law, and government should not be able to pick and choose favorites.
As important as it is, this Supreme Court argument was only one highlight among many in an incredibly successful year at the Institute for Justice. In 2021 alone, IJ launched 32 new cases and won 16 courtroom victories for ordinary Americans who want to pursue their dreams. Altogether, IJ is litigating a record 87 cases for liberty.
