The Supreme Court today issued a ruling in the Texas abortion ban case, and while the decision is technically a partial victory for abortion providers challenging the law, it’s also a cowardly abdication of the Court’s role in dispensing justice and protecting Americans’ fundamental constitutional and human rights.
The Court chose not to stop the existing ban, thereby allowing the harm that it’s inflicting on countless Texans to continue, nor did the Court address the legality of the Texas law’s horrific enforcement mechanism – vigilante lawsuits, for a $10,000 bounty, against those who assist in the provision of abortions. It just says that Texas abortion providers can argue their case in federal court. The Court also tossed out the Justice Department’s challenge to the law.
In her dissent, Justice Sonia Sotomayor wrote that today’s ruling “betrays not only the citizens of Texas, but also our constitutional system of government” and “leaves all manner of constitutional rights more vulnerable than ever before, to the great detriment of our Constitution and our Republic.”
Now, as we await the Court’s decision in this term’s other major reproductive freedom case – a direct challenge to Roe v. Wade out of Mississippi – the right to control one’s own body rests in the hands of a far-right Supreme Court.
We can protect the fundamental right to bodily autonomy by codifying the protections provided by Roe with the Women’s Health Protection Act, which the House has passed but remains stalled in the Senate.
