Today, she introduced the Fair and Independent Experts in Clemency (FIX Clemency) Act, to rectify the current clemency application review process, which is deeply flawed, burdensome, and creates more severe trauma for incarcerated people and their loved ones.

Under the Constitution, the President has the power to grant clemency — a powerful tool to reduce mass incarceration and address the injustices created by the criminal legal system.
But currently, the application review process is housed within the Department of Justice and is heavily influenced by law enforcement and prosecutorial interests, which can unilaterally prevent a clemency request from reaching the President.
Because of the system’s inefficiency and bias, more than 15,000 pending clemency petitions are currently waiting to be reviewed.
The FIX Clemency Act would create an independent clemency board made up of nine people appointed by the President, including a person who is formerly incarcerated. The board will be responsible for reviewing applications, requesting a pardon, commutation, or relief from collateral consequences of convictions, and it will recommend individuals for clemency directly to the President.
