In 2012, the California Attorney General’s Office started to harass Thomas More Law Center (TMLC), demanding the names and addresses of its major donors.
TMLC is a legal nonprofit based in Michigan that defends religious freedom, family values, and the sanctity of life.

California has no honest need for this private information.
But that hasn’t stopped the state from requiring nonprofits from across the country to provide access to the names and addresses of all their major donors annually if they fundraise in the state.

Thankfully, TMLC has fought this requirement all the way to the U.S. Supreme Court.

In today’s toxic cultural climate, donor privacy must be protected
In our society, having your confidential information leaked to the public can be dangerous.
Donors, clients, and employees of Thomas More Law Center have already faced intimidation, death threats, hate mail, boycotts, and even an assassination attempt from ideological opponents.
And with California’s sweeping requirements, nobody’s information is safe.
For one thing, the state has a history of negligence in leaking and posting donor information online where it can be seen by the public.
There’s also nothing stopping employees, contractors, or even temporary summer interns at the California Attorney General’s Office from downloading, emailing, or printing donors’ names and addresses and then disclosing them publicly.
John, if it was your private information, wouldn’t you be concerned?

If California gets its way, freedom of association will be a pipe dream
In the 1950s, Alabama tried to force the NAACP to turn over its membership lists. But the NAACP quickly realized that the information could be used by white supremacist groups to target their members.
Thankfully, the U.S. Supreme Court agreed. In NAACP v. Alabama, the High Court ruled the state could not collect and publicly release the private information of NAACP supporters whose jobs and physical safety were on the line.
The Supreme Court found the state’s position threatened the freedom of association, which guarantees our right as Americans to join and support charities that express views that align with our beliefs without fear of government interference.
But now it seems California has adopted a similar practice that clearly violates our constitutional freedoms.
And if the government gets its way, it could have major consequences for those who hold unpopular views, possibly subjecting them to harassment, threats, and losing their jobs. It could even affect you, John.
Why should you be forced to trust government officials—especially those who strongly disagree with you about important issues—to keep your name and address out of the hands of those who would abuse it? That sacrifices the very idea of free association!
We’re hopeful that the U.S. Supreme Court will hear this case. And we’re praying that thousands of people like you will see what’s at stake and commit to the fight to protect donor privacy.
