The Office of Special Counsel just found that at least 13 senior Trump officials violated the Hatch Act in the months leading up to the 2020 election, following numerous CREW complaints. Jared Kushner, Stephen Miller, Mark Meadows, Kellyanne Conway, Chad Wolf, and Kayleigh McEnany are among the officials found to have violated the law where the investigation appears to have originated with a CREW complaint. The Hatch Act is about the very foundations of our democracy. Abusing federal resources and the power and authority of government in order to cling to power is what authoritarians do—and it’s what the Trump administration systematically did in 2020 in order to boost President Trump’s re-election campaign. It was a serious attack on our democracy—one that foreshadowed Trump’s efforts to co-opt the Department of Justice to help overturn the 2020 election.
In this new report, OSC cited the serious challenges it faces in enforcing the Hatch Act. After the egregious and pervasive violations of the Trump administration, it’s clear that these challenges should not be allowed to persist. Congress must act and pass the Protecting Our Democracy Act, which would help strengthen enforcement and ensure that no future administration can ever again so blatantly weaponize the government in order to maintain power. Action on this can’t wait.
