WHY: The young plaintiffs represented and supported by Our Children’s Trust have endured more than ten years of government opposition to their constitutional claims that they have fundamental rights to a safe climate. Their endurance has paid off and the youth are prevailing against that opposition. In 2021 alone, our attorneys secured several legal victories for our young clients and their claims are finally coming to trial for the first time in Montana in 2022, and quite possibly in the U.S. federal courts as well. 

The evidence of our governments’ knowing complicity in causing the climate crisis, and the resulting harms to young people and future generations, will finally be heard in open court. We are optimistic that this evidence will lead the courts to declare in 2022 that our Constitutions require immediate science-based government action away from fossil energy to mitigate the climate crisis: the climate equivalent of landmark, history-making constitutional rights cases like Brown v. Board of Education and Obergefell v. Hodges.

2022 will thus be a watershed year for climate litigation in the U.S. and beyond.  We are eager to detail this optimistic news with you, and - as we watch the Biden legislative and COP26 agendas fail to achieve meaningful science-based climate mitigation commitments – how your support, and judicial declarations will help ensure a durable and sustainable solution to the climate crisis.
