In its opening brief in Dobbs v. Jackson Women's Health, Mississippi
explicitly and repeatedly asked the Court to overturn Roe v. Wade and
rule that there is no right to abortion protected by the U.S.
Constitution. The state's argument is a direct challenge to the core
holding of Roe: that every person has the right to decide whether to
continue their pregnancy prior to viability.
If Roe is gutted or overturned, abortion could be banned or severely
limited in half the states in the country. Already, 12 states,
including Mississippi, have trigger bans on the books which are
designed to ban abortion immediately.
There is no middle ground. Any ruling that upholds Mississippi's ban
will gut the central holding of Roe and our right to make fundamental
decisions about our lives, our futures, and our families.
