I have some important news to share with you about the Texas Heartbeat Act, also known as S.B. 8.
As you may know, this legislation was enacted at the beginning of September to protect preborn children with a detectable heartbeat from abortion. Since the human heartbeat usually becomes detectable between six and eight weeks of pregnancy, this legislation stands to protect tens of thousands of children from abortion every year in the state of Texas.
But as we expected, the abortion industry, in conjunction with the Biden Administration’s Department of Justice, began fighting this Act immediately.
On October 6, U.S. District Court Judge Robert Pitman – with unprecedented judicial activism – issued a preliminary injunction on the side of the abortion industry to block the legislation. Just a few days later, the U.S. Fifth Circuit Court of Appeals stepped in to reverse the injunction and reinstate the law.
Now, the Texas Heartbeat Act has been appealed to the U.S. Supreme Court – and Human Coalition is joining with incredible pro-life partners to be a voice for preborn children at the highest court.
Specifically, Human Coalition joined with the National Institute of Family and Life Advocates to file an amicus curiae (“friend of the court”) brief in U.S. v. Texas.
Friend of the court briefs are traditionally submitted to the Supreme Court by groups or individuals who are not party to the case but have a strong interest in the issue being considered. These briefs are reviewed by the Supreme Court Justices and can have an influence on the final ruling.
Human Coalition’s brief, which can be found here on the Supreme Court's website, argues that Texas is uniquely equipped to serve women facing unexpected pregnancies and help them overcome their challenges – which rebuts the abortion industry’s claim that abortion is necessary.
Most women are driven to abortion because of obstacles in their life. In fact, 76% of the women served by Human Coalition who are seeking an abortion say they would “prefer to parent” if their life circumstances were different.
For decades, Texas has worked to build an infrastructure of care to explicitly address these challenges and empower women with resources to meet their needs. And since the Texas Heartbeat Act was enacted, Texas has proven that the needs of families can be met through both public and private resources without abortion.

- I ask you to pray for every individual and organization involved in these cases, and to pray that the right decisions will be made to protect innocent preborn children.
- I ask you to pray for the moms and families who are considering abortion right now – that they will find a life-affirming clinic that can help provide real solutions to their circumstances instead of pushing them to abortion.
- And I ask you to pray that our culture wakes up to the horror of abortion and begins defending all human life, from womb to tomb.
