The January 6th Committee let The 147 know that they mean business yesterday when they initiated contempt proceedings against Steve Bannon. A vote to formally file charges is expected early next week.

But even if The Committee is as aggressive as possible about uncovering the truth about the January 6th Insurrection and prosecuting those responsible, Trump and his allies might still get away with it, friend.

How? The short answer is because Mitch McConnell packed the Supreme Court.

Here’s the long answer:

Bannon’s contempt proceedings were triggered when Donald Trump instructed all of his aides not to comply with subpoenas by invoking “executive privilege.” It’s been a long-standing precedent that the separation of powers enshrined in our Constitution allows the President of the United States to withhold certain testimony and documents from the other two branches of government. That begs the question: Where exactly does executive privilege end and Congress’ duty to hold the President accountable begin?

Unsurprisingly, the Supreme Court likes to avoid having to answer this question entirely by encouraging Congress and The White House to cooperate and compromise, and in the pre-Trump era, good-faith agreements were the norm. That may have been in our nation’s best interest at the time, but today it leaves many basic questions about limits of executive unanswered, such as, “Can a president invoke executive privilege after leaving office?”

Mitch McConnell used every trick in his arsenal to ensure that Trump would be able to shape the Supreme Court to his liking. Trump was able to name three justices to the Supreme Court, shifting the court from balanced to conservative for an entire generation. The Biden Administration has already made it clear that they will fight Trump’s attempt to hide behind The White House at every turn, which means a Supreme Court showdown is likely.

Do you trust Trump’s Supreme Court to do the right thing or bury the truth? Those of you old enough to remember Bush v. Gore are probably as anxious as we are.
