John, It’s no secret that former President Trump frequently abused his power while in office. He surrounded himself with loyal followers who put the desires of the commander in chief ahead of our nation’s Constitution and democratic values. He also escaped accountability in the Senate for his role in the January 6th insurrection and he now emboldens future attacks on our democracy. As Robert Kagan explains in a recent Washington Post opinion essay: “The Republican Party has used its institutional power in the political sphere to shield Trump and his followers from the consequences of their illegal and extralegal activities in the lead-up to Jan. 6…[Party leaders] run interference for the Trump movement in the sphere of legitimate politics, while Republicans in lesser positions cheer on the Jan. 6 perpetrators, turning them into martyrs and heroes, and encouraging illegal acts in the future.” In order to resolve the constitutional crisis we face, we must ensure that elected officials who participated in the January 6th insurrection are barred from holding public office ever again, as the Constitution mandates. Section 3 of the 14th Amendment disqualifies from public office any individual who has taken an oath to uphold the U.S. Constitution and then engages in insurrection or rebellion against the United States, or gives aid or comfort to those who have. By inciting a seditious, violent attack on Congress to stop the certification of a democratic election, Donald Trump engaged in insurrection and violated his oath of office. He is disqualified from ever holding public office again. Secretaries of State and election officials across the country must follow the mandate of Section 3 of the 14th Amendment to the US Constitution.
