Dear John,
The Council has been fighting in court for men, women, and children seeking asylum. This month, our hard work has led to some important, hard-fought victories.
First, we won a major victory in Al Otro Lado v. Mayorkas [[link removed]] , a fight that has taken four LONG years. This lawsuit challenged the government’s illegal turning away of asylum seekers at the Southern border. The federal court found that CBP violates the law and the U.S. Constitution when it fails to inspect and process asylum seekers who are arriving at ports of entry. This decision was a serious rebuke to CBP’s practice of turning away asylum seekers from our ports of entry, and a victory for the rule of law. The Council is litigating this case with our partners, the Southern Poverty Law Center, the Center for Constitutional Rights, and the law firm Mayer Brown LLP.
Then, we received an important decision in Garcia Ramirez et al. v. U.S. Immigration and Customs Enforcement [[link removed]] , which challenged ICE’s treatment of unaccompanied children who turn 18 in government custody. The court entered an injunction which requires ICE to seek less-restrictive alternatives to detention for these teens and re-train its officers on custody determinations. They must also document all custody decisions and provide monthly reports and documentation to class counsel. The injunction will remain in effect for five years. The Council is litigating this case with the National Immigrant Justice Center and the law firm Kirkland & Ellis LLP.
