Today, we just announced the release of our newest report: “In the Dead of Night: The Supreme Court's Use of the Shadow Docket to Enact a Radical and Hyper-Partisan Agenda”.  

The shadow docket, traditionally used to handle noncontroversial procedural decisions and emergency relief, has become the latest weapon the Court’s conservative majority has used to undermine the constitutional rights and hard-won legal protections of everyday people. These decisions come down, without the Court — or the public — having properly heard the merits of a case.  

Our report outlines eight key examples of abuse, including: 

• Allowing the unconstitutional Texas abortion ban to take effect; 
• Allowing President Trump’s Muslim ban; and 
• Allowing President Trump’s ban on trans military service members. 

Court reform is clearly imperative, or we can expect these abuses of power to continue undermining our basic constitutional protections.
