Danger in the Shadows: Supreme Court Uses Shadow Docket to Threaten Abortion Rights [[link removed]]
BY MICHELE GOODWIN | Shortly before midnight on September 1, the Supreme Court issued an unsigned, one-paragraph opinion letting stand the Texas abortion ban S.B. 8—otherwise known as the “Texas Heartbeat Act,” which essentially guts access to abortion in Texas while technically preserving Roe v. Wade and Planned Parenthood v. Casey. In other words, the Supreme Court permitted the evisceration of Roe without any constitutional analysis.
With this ruling, the Supreme Court’s so-called shadow docket can no longer be denied, nor can its increasingly unusual manner of judicial review be ignored. Both raise concerns about the rule of law and independent judicial review, not to mention the legitimacy and credibility of the U.S. Supreme Court.
“Equal Rights May Ring Hollow”: The Precarious State of Abortion Rights [[link removed]]
BY MINDY ROSEMAN and RACHEL REBOUCHÉ | We may be watching the endgame of constitutional protection for the right to abortion in the United States. Two cases—Roe v. Wade and Planned Parenthood v. Casey—prohibit states from creating undue burdens on a pregnant person’s right to end a pre-viability pregnancy.
As a practical matter, for many in the U.S., abortion access at any stage of pregnancy presents significant and unnecessary challenges, and access is almost non-existent at the later stages of pregnancy. That has not kept many Southern and Midwestern states from passing legislation that flagrantly flaunts the holdings of Roe and Casey.
Women on Their Choice To Be Child-Free [[link removed]]
BY SARAH BAILLIE | World Contraception Day—September 26—was conceived (no pun intended) to improve awareness of all forms of contraception and help people make informed choice about their sexual and reproductive health. Access to contraception has empowered many women to choose if and when they would like to have children. While there is a trend of women having fewer children, others are opting out of having children altogether.
In honor of this important day, I interviewed women of multiple generations about their choice to be child-free.
