California is on the verge of adopting new legislation ([link removed]) that would improve working conditions for port truck drivers and meet climate goals by attaching workforce standards to clean fleet subsidies. These bills mark a new chapter in state policy after decades of advocacy by labor and environmental organizations to advance climate and economic justice goals.

SB 338 and AB 794 are complementary bills that work together to protect California’s essential truck drivers, who keep our families fed and the economy moving. California cannot tolerate the misclassification of port drivers, and much less subsidize worker abuse, wage theft and indentured servitude.

SB 338, championed by Senator Lena Gonzalez, strengthens existing law regarding misclassification of port truck drivers that makes powerful retailers and other cargo owners jointly liable for violations if they knowingly contract with a trucking company that misclassifies.

AB 794, championed by Assemblymember Wendy Carrillo, prohibits trucking companies that are in violation of misclassification laws from receiving publicly-funded subsidies to purchase clean trucks. The port trucking Industry impacts frontline communities, from the air we all breathe to the working conditions of port drivers. The only path forward to zero emissions is one that addresses the underlying misclassification of drivers.

For over a decade, LAANE has fought alongside port truck drivers to address systemic wage theft and misclassification at our ports. Trucking companies have long avoided all responsibility for their workers by misclassifying them as independent contractors and by forcing drivers into predatory leases for expensive new trucks. It’s long past time for these abusive, illegal practices to end.

Governor Newsom has an opportunity to continue setting an example for the nation on how we can both clean the air and uplift workers. Tell Governor Newsom: make history by signing SB 338 and AB 794 into law. ([link removed])
