On Friday, October 18, Robert F. Kennedy, Jr. and Robert Krakow filed an appeal in C.F. v. New York City Dept. of Health and Mental Hygiene and Dr. Barbot, MD, challenging the mandate to compel vaccination against measles for all non-immune residents in four zip codes in Brooklyn, NY. Children’s Health Defense supported a challenge in April 2019, seeking a temporary restraining order and preliminary injunction. While the New York trial court denied relief, the appellate department will now consider plaintiffs’ arguments on appeal.

The New York City Measles Vaccine Mandate—Past and Future
On September 5, Robert Krakow and CHD’s Mary Holland attended a talk that the NYC Commissioner of Health and Mental Hygiene, Dr. Oxiris Barbot, gave at New York Law School, entitled “Measles: NYC Policy and Thoughts on the Anti-Vaccine Movement.”
After heaping vitriol on the so-called anti-vaccine movement and explaining why its misinformation should be censored, Dr. Barbot accepted a gift from the moderator, a book by Professor Nadine Strossen entitled Hate: Why We Should Resist It with Free Speech, Not Censorship. It seemed an ironic twist.
