HOUSE COMMITTEE APPROVES DISASTROUS IMMIGRATION PROVISIONS FOR BUDGET RECONCILIATION EFFORT

The House Judiciary Committee approved a number of immigration policy changes it hopes to add to the $3.5 trillion budget reconciliation bill that Congressional Democrats hope to pass this fall. While the policy changes passed through the Committee on a party-line vote, with only Democrat support, it's yet to pass muster with the more moderate members of the House Democratic caucus.

Most of you have received action alerts and/or Jim's memo with details on some of those provisions. Most importantly, the legislation:

  • Grants amnesty to at least 8 million illegal aliens, including:

    • approximately 3 million who qualify for the DACA executive or Dream Act amnesties

    • 5-6 million who illegally hold an "essential" job, including jobs in agriculture, food processing, construction, and health care

    • 320,000 who have received Temporary Protected Status

    • approximately 150,000 who have been shielded from deportation through Deferred Enforced Departure

  • Blocks ICE from enforcing the law against anyone who might be eligible for amnesty, effectively creating a nationwide enforcement freeze

  • "Recaptures" and issues an estimated 630,000 supposedly "unused" green cards from both the employment and family categories dating all the way back to 1992

  • Awards green cards to visa lottery winners who were denied entry as a result of Pres. Trump's travel ban or COVID-19 entry ban

  • Allows aliens with an approved green card petition who have been on the visa waiting list for at least two years and are legally present in the United States to buy a green card regardless of whether one is currently available under the annual numerical limits

JUDGE'S DECISION COULD MAKE BIDEN'S BORDER CRISIS EVEN WORSE

Border Patrol agents made more than 195,000 apprehensions in August -- a 313% increase compared to the previous year -- according to new data released by the Department of Homeland Security. It's the fifth consecutive month where Border Patrol agents made more than 170,000 apprehensions.

According to the government data, the Biden administration has expelled roughly half of those who were apprehended under Title 42 -- a provision in the public health law that allows an administration to deny entry into the United States if it would pose a risk to public health. Pres. Trump authorized the use of Title 42 at the start of the COVID-19 pandemic, but the Biden Administration has limited its application to single adults and certain family groups.

However, D.C. federal judge Emmet Sullivan issued a nationwide temporary injunction yesterday halting the administration's use of Title 42. Judge Sullivan has given the Biden administration 14 days to appeal before the injunction goes into effect.

Should Sullivan's injunction stand, it could force the administration to release tens of thousands of illegal border crossers each month into the interior of the country. And that doesnt include the likely increase in surge numbers that could result from this and other policy changes, as well as Congress' amnesty discussions.

Sullivan issued a similar injunction when Trump was in office, but the Trump administration was able to get the decision overturned. It's too soon to tell if the Biden administration will fight the injunction with the same level of vigor that the Trump administration did. We know there are countless numbers of people within the Biden administration who have been pushing the President to end the use of Title 42.

To make matters even worse, approximately 10,000 Haitians have assembled at the Southwest border over the last few days looking to gain entry into the United States. And more are expected to come, adding to the already dire situation at the border.
