Without intervention from the Supreme Court, America’s most restrictive state abortion law — SB 8 — went into effect in Texas this morning.
The law bans all abortions after six weeks — well before many people even know they are pregnant — and empowers private citizens to sue individuals and organizations who “aid and abet” people exercising their constitutional right to an abortion.
With their inaction, this far-right Supreme Court has essentially overturned the constitutional right to access abortion in the second largest state in this country. It’s clearer than ever: We need to expand the Supreme Court.

Expanding the Court is not a radical idea. Congress is well within its rights to expand the Supreme Court under Article III of the Constitution. Historically, the court has fluctuated from five to ten justices before settling at the current number of nine justices.
All Congress needs to do is pass the Judiciary Act of 2021 and have President Biden sign it into law. By increasing the number of seats, we can ensure that the highest court in the nation is no longer ruled by far-right extremists for decades to come.
Republicans and the ideologues they have installed on the Court have made it crystal clear. They have no intention of trying to win popular support for their odious policies in fair elections. Instead, they intend to use every lever of power they have to suppress the vote, undermine democracy, block progressive legislation from being enacted, and allow our rights to be stripped away.
We can prevent the far-right from taking even more action to harm working people and our democracy, but it’s up to Congress to do it. Add your name to our petition calling on Congress to intervene NOW and expand the Supreme Court by passing the Judiciary Act of 2021.
