Horrible news out of the federal courts: A judge in the Fifth Circuit Court of Appeals upheld a Texas ban on the most common method of abortion used after 15 weeks: dilation and evacuation.

This ban is about cutting off abortion access. States like Texas create barriers to abortion that push patients later into pregnancy, and then they ban procedures at that point in pregnancy.

We know this violates the protections of Roe v. Wade and is an unconstitutional ban, but the Fifth Circuit ignored the Constitution and upheld Texas’ law anyway.

This federal court upholding an unconstitutional law shows an escalation from anti-choice judges. They're not waiting for a SCOTUS decision — they’re banning abortion with the power they already have.

And not to over-alarm you, but this decision is a huge deal — it’s the first federal court of appeals to uphold a ban that violates the protections of Roe v. Wade, and the only court that can undo this decision now is SCOTUS.

In fact, this decision will be used by those trying to overturn Roe v. Wade this year, when the Supreme Court considers a similar 15-week ban out of Mississippi. We cannot fail to respond.

That’s why we have to coalesce our power and work even harder to defeat this overly funded anti-choice minority by elevating prochoice champions in every election, in every state, in every race.
