CALL TODAY:
It’s October 15th.
What does that mean for immigrant families?

Dear Allies,

Today is the day that the Department of Homeland Security (DHS) public charge rule was supposed to go into effect. As of last night, Federal Judges have issued 5 preliminary injunctions, including nationwide injunctions from courts in New York, Washington and Maryland. This is a huge victory for immigrant families. The legal fight will continue, but for now, the public charge rules in the United States have not changed and we will follow the policies set forth in the 1999 guidance.

Unfortunately, the judges’ rulings do not affect the public charge determinations made by the Department of State (DOS). The DOS policy affects non-U.S. citizens who go through consular processing in their home country before entering the U.S. and green card applicants who are required to leave the U.S. to seek status through consular processing. On October 11, the Department of State (DOS) issued an interim final rule that aligns its definition of public charge to that contained in the DHS final rule. This DOS rule is still scheduled to take effect today; however, DOS officials told a CBS news reporter that the rule will not be implemented until a new form is finalized. We will keep you posted as we learn more.

Over the coming days, we will be updating the many documents on our website to reflect recent changes.

Please join us today at 2:30pm ET/ 11:30am PT, for a brief all-campaign call where we’ll share out a state of play about the many policies in flux -- including public charge rules from DHS, DOS and DOJ -- as well as Trump’s recent health insurance proclamation. We will provide an overview of each of these policies, the common hateful thread between them, and the most accurate messages to share with direct service providers and affected community members.
