Today, a U.S. district court in Texas ruled that the Deferred Action for Childhood Arrivals (DACA) program is unlawful. This decision was in response to an anti-immigrant lawsuit led by Texas and other states challenging the DACA program’s legality.

What this means: The federal government is blocked from granting any new first-time DACA applications. IMPORTANT: People with DACA will not lose their protections, and for now pending renewal applications will be adjudicated, and current DACA recipients can continue to submit renewal applications. We encourage anyone who is eligible to renew their DACA to do so.

Immigrant youth have lived through years of politically motivated attacks on DACA that put them at risk of being separated from their loved ones and being deported. This decision again upends the lives of hundreds of thousands of DACA recipients — so it’s crucial that Congress act now.

DACA has improved the lives of hundreds of thousands of people. The policy has been successful and transformative and opened the door for undocumented immigrant youth who grew up in the U.S. to get their education, start businesses, and support their families without fear of deportation.

NILC has long been a leader in fighting alongside immigrant youth to ensure that they can remain and thrive in this country. We helped conceive, implement, and defend DACA alongside our courageous plaintiffs when the previous administration tried to end it. We took our fight all the way to the Supreme Court — and won — and kept fighting in the courts to fully restore DACA. Now all of our progress is at risk unless Congress takes swift action.

President Biden and the majority of Americans support a pathway to citizenship, so what is Congress waiting for? A pathway to citizenship is the only way to permanently protect hundreds of thousands of immigrants whose home is here.
