Title 42 is an obscure public health law that the Trump administration used to prohibit entry to the United States for anyone except U.S. citizens, legal permanent residents (green card holders) and their families from entering the country.

In March 2020, when the COVID-19 pandemic began escalating in the U.S., Stephen Miller and the Trump Administration implemented Title 42 despite the fact that public health experts agreed that there was no public health rationale for doing so.

Despite claims that Title 42 has no ill intentions towards immigrants and that it is needed to protect against the spread of COVID-19, the policy has done much more harm than good.

Under Title 42, hundreds of thousands of unaccompanied children, families and individuals have been denied entry, pushed into Mexico or taken into custody, held for days or weeks, and then deported back to the countries they fled from without giving them the opportunity to seek asylum.

The American Immigration Council reports that more than 520,000 individuals have been expelled from entering the U.S. under Title 42 as of February 2021.

When migrants are sent back to Mexico or their home countries they face the same circumstances that forced them to flee in the first place. Many of them are beaten, robbed, kidnapped, and assaulted.

The Biden Administration has the power to end Title 42 and allow migrants to seek asylum in the U.S.

In November 2020, a federal judge ruled that unaccompanied children would be exempt from Title 42 because deporting them was in violation of the Trafficking Victims Protection Reauthorization Act. However, this is not enough.

We must ensure that everyone seeking asylum is able to do so under a fair and humane system.

Seeking asylum is legal under international and domestic law. Every refugee and asylum seeker has the right to request a safe home in the United States.

Title 42 prohibits migrants from seeking asylum and takes away their right to due process under the disguise of unfounded public health concerns. There is NO public health rationale for keeping this policy in place.

It is time for the Biden Administration to get rid of Trump’s old policies that do not work.
